BILL NUMBER:A10182 TITLE OF BILL: An act to amend the environmental conservation law, in relation to the discharge of a longbow over water in certain instances PURPOSE: To allow the safe discharge of a longbow over water by a person bow fishing if no dwelling, house, public structure, livestock or person is situated in the line of discharge less than 500 feet from the point of discharge. JUSTIFICATION: People from all over the state, nation and world are drawn to New York State for its rich outdoor recreation. This legis- lation would permit those who enjoy bow fishing to conduct their recre- ation with more flexibility and in a manner that is both safe and enjoy- able. The Department of Environmental Conservation recognizes the merit of reducing the current 500 foot requirement for the use of longbows and has identified it as an item to be amended in the Environmental Conver- sation Law. As the arrow is ultimately discharged directly into the water in close proximity to the archer, the nature of the sport already limits the possibility of accidental targets. CALHOUN, ERRIGO, GIGLIO, GUNTHER, MOLINARO, SAYWARD -- read once and referred to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to the discharge of a longbow over water in certain instances THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraph 2 of paragraph a of subdivision 4 of section 11-0931 of the environmental conservation law is amended to read as follows: (2) discharge a firearm or long bow within five hundred feet from a dwelling house, farm building or farm structure actually occupied or used, school building, school playground, or occupied factory or church EXCEPT THAT THE PROVISIONS OF THIS SUBPARAGRAPH SHALL NOT APPLY TO THE DISCHARGE OF A LONGBOW OVER WATER BY A PERSON BOW FISHING IF NO DWELL- ING, HOUSE, OR PUBLIC STRUCTURE, LIVESTOCK OR PERSON IS SITUATED IN THE LINE OF DISCHARGE LESS THAN FIVE HUNDRED FEET FROM THE POINT OF DISCHARGE; S 2.
