McENENY, CANESTRARI -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to contingency budgets in school districts with more than 5 percent of their enrollment in char- ter schools THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 2023 of the education law is amended by adding a new subdivision 5 to read as follows: 5. FOR THE TWO THOUSAND NINE--TWO THOUSAND TEN SCHOOL YEAR, NOTWITH- STANDING THE PROVISIONS OF THIS SECTION THE BOARD OF EDUCATION OF ANY SCHOOL DISTRICT WITH MORE THAN FIVE PERCENT OF ENROLLMENT ATTENDING CHARTER SCHOOLS MAY ADOPT A CONTINGENCY BUDGET WITHIN THE CAP REQUIRED BY SUBDIVISION FOUR OF THIS SECTION AND INCLUDING ANY EXPENSES OF THE DISTRICT DEEMED NECESSARY FOR OPERATION BY THE BOARD OF EDUCATION SUCH AS EQUIPMENT, STUDENT SUPPLIES, PUBLIC USE OF SCHOOL BUILDINGS WITHOUT A FEE AND SALARY INCREASES FOR NON-CONTRACTUAL EMPLOYEES.
