AN  ACT  to  amend  the public health law, in relation to requiring food
  service establishments to post notice relating to the  use  of  peanut
  oil

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 1352 of the public health law is amended by  adding
a new subdivision 5 to read as follows:
  5.  ANY  FOOD  SERVICE ESTABLISHMENT, AS DEFINED IN THE STATE SANITARY
CODE, WHERE PEANUT OIL IS USED FOR  THE  PREPARATION  OR  CONVEYANCE  OF
FOODS  FOR CONSUMERS, SHALL PROVIDE NOTICE TO PATRONS BY MEANS OF SIGNS,
PRINTED MATERIALS OR OTHER WRITTEN COMMUNICATION, TO  READ  AS  FOLLOWS:
"PEANUT  OIL  IS USED BY STAFF IN THE PREPARATION AND CONVEYANCE OF FOOD
IN THIS ESTABLISHMENT. IF YOU ARE ALLERGIC TO PEANUT  OIL,  PLEASE  TAKE
APPROPRIATE PRECAUTIONS."
  S  2.  This  act shall take effect on the ninetieth day after it shall
have become a law.
