BACALLES, CANESTRARI, COOK, DelMONTE, ESPAILLAT, FIELDS, GABRYSZAK, GALEF, GOTTFRIED, HEAST- IE, JAFFEE, MAGEE, McENENY, McKEVITT, MILLMAN, PHEFFER, QUINN, REILLY, ROBINSON, RUSSELL, SAYWARD, SCHIMMINGER, SWEENEY, TITONE, TOWNSEND, WEISENBERG -- (at request of the Higher Education Services Corpo- ration) -- read once and referred to the Committee on Higher Education AN ACT to amend the education law, in relation to the board of trustees of the higher education services corporation THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivisions 3 and 4 of section 652 of the education law, subdivision 3 as amended by chapter 653 of the laws of 2004, subdivision 4 as amended by chapter 297 of the laws of 1997, are amended to read as follows: 3. The corporation shall be governed and all of its corporate powers exercised by a board of trustees which shall consist of fifteen members, [ten] NINE of whom shall be appointed by the governor with the advice and consent of the senate[, three of whom]. THE MEMBERS NOT REQUIRING THE ADVICE AND CONSENT OF THE SENATE shall be the commissioner of educa- tion, the chancellor of the state university, the chancellor of the city university of the city of New York, and [four of whom shall be] THREE students. One such student shall be the president of the student assem- bly of the state university of New York, one such student shall be the chair of the united student senate of city university of New York, [one such student shall be a student currently registered and in full time attendance at a degree granting independent institution of higher educa- tion in New York,] and one such student shall be a student registered in a full time course of study at a state university community college. In the event a student who shall be a member by reason of his or her office in a student organization shall fail to qualify, the student who holds EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
