BILL NUMBER: S1283

TITLE OF BILL :
An act to authorize the commissioner of transportation to alienate and
convey certain land to the Community Ambulance Company, Inc.


PURPOSE :
Authorizes the Commissioner of Transportation to alienate and convey
certain land to the Community Ambulance Company, Inc.

SUMMARY OF PROVISIONS :
Section 1 of the bill authorizes the Commissioner of Transportation to
alienate and convey property on Sunrise Highway in the Hamlet of
Sayville, Long Island, to the Community Ambulance Company, Inc. for
the purposes of expanding their operation of a not-for-profit
ambulance company.

§ 2 stipulates that the authorization contained in section 1 of the
bill shall take effect only upon the condition that Community
Ambulance Company, Inc. pays the fair market value of the property
being alienated by this act.

§ 3 specifies the boundaries of the parcel of land authorized to be
alienated and conveyed to Community Ambulance Company, Inc. pursuant
to this act.

§ 4 subjects such conveyance of land to a right of first refusal in
favor of the State should Community Ambulance Company, Inc. attempt to
sell such property or ceases to use such property for the purposes
described in section 1 of this act.

§ 5 provides the effective date.

JUSTIFICATION :
The New York State Department of Transportation owns this parcel of
land and is willing to declare it as surplus. Under current law, when
there is excess state property that is no longer needed the state must
sell it at public auction. This legislation is necessary to convey
this parcel of land to the Community Ambulance Company in order that
they may move to a larger headquarters.
