Requires all senior living facilities to employ an independent ambulance service for the provision of emergency medical services and transport at such facilities; a senior living facility is any dwelling or collective group of dwellings at a common location providing housing to more than 50 persons who are over 65 years old.

BILL NUMBER: S2220 TITLE OF BILL : An act to amend the public health law, in relation to senior living facilities PURPOSE OR GENERAL IDEA OF BILL : To establish requirements for independent emergency ambulances and medical support staff at all new senior living centers. SUMMARY OF SPECIFIC PROVISIONS : Amends the Public Health Law, creating a new article 30-D "Senior Living Facilities" and two new sections 3080 and 3081 to require any new senior living facility (any such dwelling or collective group of dwellings at one location with more than 50 persons living in such center over the age of 65) to employ independent ambulances on-site and sufficient emergency support staff for on-premise emergencies. JUSTIFICATION : The senior age group in the United States is growing significantly, and increasing measures are being taken to ensure the proper health and well-being of seniors. One step in ensuring quality care/housing for seniors would be the building of more senior living facilities. Such facilities provide minimal assistance for seniors, allowing them to continue to live independently. Although, in order to decrease the

DIAZ -- read twice and ordered printed, and when printed to be committed to the Committee on Aging AN ACT to amend the public health law, in relation to senior living facilities THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding a new article 30-D to read as follows: ARTICLE 30-D SENIOR LIVING FACILITIES SECTION 3080. DEFINITION. 3081. AMBULANCE SERVICE. S 3080. DEFINITION. AS USED IN THIS ARTICLE, "SENIOR LIVING FACILITY" SHALL MEAN ANY DWELLING OR COLLECTIVE GROUP OF DWELLINGS AT A COMMON LOCATION PROVIDING HOUSING TO MORE THAN FIFTY PERSONS WHO ARE OVER THE AGE OF SIXTY-FIVE YEARS. S 3081. AMBULANCE SERVICE. EVERY SENIOR LIVING FACILITY SHALL EMPLOY AN INDEPENDENT AMBULANCE SERVICE, CERTIFIED PURSUANT TO SECTION THREE THOUSAND FIVE OF THIS CHAPTER, FOR THE PROVISION OF EMERGENCY MEDICAL SERVICES AND TRANSPORT. THE COMMISSIONER AND THE STATE EMERGENCY MEDICAL SERVICES COUNCIL SHALL ESTABLISH STANDARDS FOR THE PROVISION OF EMERGEN- CY MEDICAL SERVICES AND TRANSPORT, AND THE STAFFING OF AMBULANCES AT SENIOR LIVING FACILITIES PURSUANT TO ARTICLE THIRTY OF THIS CHAPTER. S 2. This act shall take effect on the first of January next succeed- ing the date on which it shall have become a law; provided that any rules and regulations necessary for the implementation of the provisions of this act on its effective date are authorized and directed to be promulgated and completed on or before such date.
