BILL NUMBER: S2437 TITLE OF BILL : An act to amend the agriculture and markets law, in relation to including farm land which includes agricultural amusements within provisions of law relating to agricultural districts PURPOSE : To clarify that those portions of land used in support of a farm operation which include corn and hay bale mazes are eligible for the benefits' of the agricultural districts law. SUMMARY OF PROVISIONS : Amends paragraph c of subdivision 4 of section 301 of the Agriculture and Markets Law to clarify that those portions of land used in support of a farm operation which include corn and hay bale mazes are eligible for the benefits of the agricultural districts law. JUSTIFICATION : This state is home to some 38,000 farms encompassing roughly 7.8 million acres of cropland, pasture and woodlands from Erie County to

YOUNG -- read twice and ordered printed, and when printed to be committed to the Committee on Agriculture AN ACT to amend the agriculture and markets law, in relation to includ- ing farm land which includes agricultural amusements within provisions of law relating to agricultural districts THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph c of subdivision 4 of section 301 of the agricul- ture and markets law, as amended by chapter 445 of the laws of 2002, is amended to read as follows: c. Land used in support of a farm operation or land used in agricul- tural production, constituting a portion of a parcel, as identified on the assessment roll, which also contains land qualified for an agricul- tural assessment. SUCH LAND SHALL INCLUDE LAND USED FOR AGRICULTURAL AMUSEMENTS WHICH ARE PRODUCED FROM CROPS GROWN OR PRODUCED ON THE FARM, PROVIDED THAT SUCH CROPS ARE HARVESTED AND MARKETED IN THE SAME MANNER AS OTHER CROPS PRODUCED ON SUCH FARM. SUCH AGRICULTURAL AMUSEMENTS SHALL INCLUDE, BUT NOT BE LIMITED TO, SO-CALLED "CORN MAZES" OR "HAY BALE MAZES". S 2. This act shall take effect immediately.
