BILL NUMBER: S3644 TITLE OF BILL : An act to amend the social services law, in relation to requiring at least one employee of any child day care facility to be trained and certified in cardiopulmonary resuscitation and first aid PURPOSE : This legislation requires that during operating hours at least one employee of child care programs and child day care centers be certified in first aid and cardiopulmonary resuscitation (CPR). SUMMARY OF PROVISIONS : Section 390-a of the social services law is amended by adding a new subdivision 5. Currently day care providers and staff are mandated to have basic health and safety training, but CPR is not part of the required training. JUSTIFICATION : The safety and welfare of the children of New York is of paramount importance. The Office of Children and Family Services (OCFS) encourages day care providers to take CPR courses, but the law does not require them to. This bill would require that at least one employee who has been trained in CPR is present during operating hours.

Section 390-a of the social services law is amended by adding a new subdivision 5 to read as follows: 5. A. THE SITE PROVIDER OF A FAMILY DAY CARE HOME OR GROUP FAMILY DAY CARE HOME SHALL PROVIDE THAT AT LEAST ONE EMPLOYEE WHO HOLDS A VALID CERTIFICATION IN A COURSE OF STUDY IN FIRST AID KNOWLEDGE AND SKILLS AND CARDIOPULMONARY RESUSCITATION, WITH AN EMPHASIS ON PROVIDING THAT AID TO CHILDREN, AS APPROVED BY THE COMMISSIONER OF THE OFFICE OF CHILDREN AND FAMILY SERVICES, BE ON PREMISES DURING THE OPERATING HOURS OF SUCH FAMI- LY DAY CARE HOME OR GROUP FAMILY DAY CARE HOME. B.
