TITLE OF BILL :
An act to amend the agriculture and markets law and the tax law, in
relation to contributions to the animal population control fund


PURPOSE OF BILL :
Authorizes a tax check off for gifts and contributions to the Animal
Population Control Fund which provides to cat and dog owners low cost
spaying and neutering services.

SUMMARY OF PROVISIONS :
Agriculture and Markets Law is amended to allow the Commissioner to
accept these contributions and the tax law is amended to add two new
sections, 209-g and 630-b, which allow corporate and individual
taxpayers to donate to the Animal Population Control Fund.

JUSTIFICATION :
There is no doubt that across this state and country we are facing a
major crisis with the overpopulation of unwanted cats and dogs as more
and more animals are being turned over to shelters and other pet
rescue organizations. According to the National Council on Pet
population Study and Policy, between 1994 and 1997 over 15 million
cats and dogs were entered into animal shelters and this number does
not seem to be decreasing. To address this burgeoning problem, the
Department of Agriculture and Markets administers the Animal
population Control Fund which provides vouchers for the low cost
spaying and neutering of cats and dogs. To supplement this successful
program, this bill would allow taxpayers to donate directly to this
fund when filing their Corporate or personal income tax returns and in
this small way greatly enhance the state's ability to assist with the
spaying and neutering of animals. Through this increased funding and
public awareness we will, hopefully, be able to finally control the
overpopulation of our furry friends in and throughout New York State.

AN  ACT  to  amend  the  agriculture and markets law and the tax law, in
  relation to contributions to the animal population control fund

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Subdivision  5  of  section  117-a of the agriculture and
markets law, as added by chapter 473 of the laws of 1995, is amended  to
read as follows:
  5.  The  commissioner  may solicit and accept funds from any public or
private source to help carry out the provisions of this section, INCLUD-
ING, BUT NOT LIMITED TO, CONTRIBUTIONS RECEIVED PURSUANT TO SECTIONS TWO
HUNDRED NINE-H AND SIX HUNDRED THIRTY-C OF THE TAX LAW.
  S 2. The tax law is amended by adding a new section 209-h to  read  as
follows:
  S  209-H.  GIFTS FOR THE ANIMAL POPULATION CONTROL FUND. EFFECTIVE FOR
ANY TAX YEAR COMMENCING ON OR AFTER JANUARY FIRST, TWO THOUSAND  ELEVEN,
A TAXPAYER IN ANY TAXABLE YEAR MAY ELECT TO CONTRIBUTE TO THE SUPPORT OF
THE  ANIMAL  POPULATION  CONTROL FUND. SUCH CONTRIBUTION SHALL BE IN ANY
WHOLE DOLLAR AMOUNT AND SHALL NOT REDUCE THE AMOUNT OF STATE TAX OWED BY
SUCH TAXPAYER. THE COMMISSIONER SHALL INCLUDE  SPACE  ON  THE  CORPORATE
INCOME  TAX  RETURN  TO  ENABLE  A  TAXPAYER  TO MAKE SUCH CONTRIBUTION.
NOTWITHSTANDING ANY OTHER  PROVISION  OF  LAW,  ALL  REVENUES  COLLECTED
PURSUANT  TO  THIS  SECTION  SHALL  BE CREDITED TO THE ANIMAL POPULATION
CONTROL FUND AND SHALL BE USED ONLY FOR  THOSE  PURPOSES  ENUMERATED  IN
SECTION NINETY-SEVEN-XX OF THE STATE FINANCE LAW.

  S  3.  The tax law is amended by adding a new section 630-c to read as
follows:
  S  630-C.  GIFTS FOR ANIMAL POPULATION CONTROL FUND. EFFECTIVE FOR ANY
TAX YEAR COMMENCING ON OR AFTER JANUARY FIRST, TWO THOUSAND  ELEVEN,  AN
INDIVIDUAL  IN  ANY  TAXABLE  YEAR MAY ELECT TO CONTRIBUTE TO THE ANIMAL
POPULATION CONTROL FUND. SUCH CONTRIBUTION SHALL BE IN ANY WHOLE  DOLLAR
AMOUNT  AND  SHALL NOT REDUCE THE AMOUNT OF STATE TAX OWED BY SUCH INDI-
VIDUAL. THE COMMISSIONER SHALL INCLUDE SPACE ON THE PERSONAL INCOME  TAX
RETURN  TO ENABLE THE TAXPAYER TO MAKE SUCH CONTRIBUTION.  NOTWITHSTAND-
ING ANY OTHER PROVISION OF LAW, ALL REVENUES COLLECTED PURSUANT TO  THIS
SECTION SHALL BE CREDITED TO THE ANIMAL POPULATION CONTROL FUND AND USED
ONLY  FOR  THOSE  PURPOSES  ENUMERATED IN SECTION NINETY-SEVEN-XX OF THE
STATE FINANCE LAW.
  S 4. This act shall take effect immediately.
