BILL NUMBER: S7826 TITLE OF BILL : An act to amend chapter 545 of the laws of 2003, amending the social services law relating to the assisted living program, in relation to extending the effectiveness thereof PURPOSE : The purpose of this legislation is to provide for the expansion of assisted living programs unable to meet the demand for available beds. SUMMARY OF PROVISIONS : Section one extends the demonstration program allowing for the expansion of assisted living programs unable to meet the demand for available beds. Section two states this bill shall take effect immediately. JUSTIFICATION : This bill continues the demonstration program established in Chapter 593 of the laws of 2003 and amended by Chapter 545 of the laws of 2005, to allow certain assisted living facilities to increase their number of assisted living beds by up to thirty percent of its approved bed level to accommodate individuals awaiting placement into the assisted living program. DUANE -- read twice and ordered printed, and when printed to be committed to the Committee on Social Services AN ACT to amend chapter 545 of the laws of 2003, amending the social services law relating to the assisted living program, in relation to extending the effectiveness thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 2 of chapter 545 of the laws of 2003, amending the social services law relating to the assisted living program, as amended by chapter 593 of the laws of 2005, is amended to read as follows: S 2. This act shall take effect immediately and shall be deemed repealed September 1, [2010] 2013. Provided that, any person placed in an assisted living program pursuant to paragraph (g) of subdivision 3 of section 461-1 of the social services law, as added by section one of this act, prior to the repeal of this act shall be authorized to remain in such program and receive the services thereof after the repeal of this act. Furthermore, state funding for the provision of assisted living program services authorized by this act shall continue after the repeal of this act for any person to which the provisions of this act shall continue to apply.
