BILL NUMBER:S8001 TITLE OF BILL: An act to amend the education law, in relation to charter schools PURPOSE OR GENERAL IDEA OF THE BILL: The purpose of this bill is to provide for a technical clarification regarding the approval and issuance process for charters. SUMMARY OF SPECIFIC PROVISIONS: This bill clarifies that for charters issued pursuant to a competitive request for proposals process pursuant to section 2852(9-a) of the Education Law, applications would be deemed approved and issued pursuant to the requirements in current law provided for in sections 2852(5)(2852 (5-a)(and 2852 (5-b) of the Education Law. JUSTIFICATION: Under existing law the board of trustees of the state university of New York (SUNY Trustees) is an autonomous, independent authorizer. The Board of Regents serves the administrative role of issuing charters approved by SUNY. This bill would provide for a clarification to the approval and issuance process for charters issued pursuant to the competitive request for proposals established pursuant to A.11310. As such, SUNY recommended charter applications will continue to be deemed approved and issued

OPPENHEIMER -- (at request of the Governor) -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the education law, in relation to charter schools THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (f) of subdivision 9-a of section 2852 of the education law, as added by a chapter of the laws of 2010 amending the education law relating to charter schools, as proposed in legislative bill number A. 11310, is amended to read as follows: (f) The board of regents shall be the only entity authorized to issue a charter pursuant to this article. The board of regents shall consider applications submitted directly to the board of regents and applications recommended by the board of trustees of the state university of New York. PROVIDED, HOWEVER, THAT ALL SUCH RECOMMENDED APPLICATIONS SHALL BE DEEMED APPROVED AND ISSUED PURSUANT TO THE PROVISIONS OF SUBDIVISIONS FIVE, FIVE-A AND FIVE-B OF THIS SECTION. S 2. This act shall take effect on the same date and in the same manner as a chapter of the laws of 2010 amending the education law relating to charter schools, as proposed in legislative bill number A. 11310, takes effect.
