AN ACT to amend the education law and the state finance law, in relation
  to increasing the transparency of the local impact  of  state  policy-
  making

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1.  The education law is amended by adding a new section 207-b
to read as follows:
  S 207-B. REGULATORY PROCESS. THE REGENTS SHALL  PRESCRIBE  BY  RULE  A
FORMAL PROCESS BY WHICH THE INPUT OF SCHOOL DISTRICTS OF THE STATE SHALL
BE  SOUGHT  IN  THE DEVELOPMENT OF THE COMMISSIONER'S REGULATIONS.  SUCH
INPUT SHALL INCLUDE BUT NOT BE LIMITED TO AN ESTIMATE  OF  THE  COST  TO
SCHOOL  DISTRICTS  OF  ANY NEW PROGRAM, PROJECT OR ACTIVITY THAT WILL BE
MANDATED BY ANY SUCH REGULATION AND SHALL BE INCORPORATED INTO ANY REGU-
LATORY IMPACT STATEMENT DEVELOPED IN RELATION TO SUCH REGULATION.
  S 2. Section 8 of the state finance law is amended  by  adding  a  new
subdivision 21 to read as follows:
  21. PREPARE AND PUBLISH, NO LATER THAN OCTOBER FIFTEENTH IN EACH YEAR,
A  REPORT AGGREGATING THE INFORMATION FROM FISCAL NOTES THAT ACCOMPANIED
ANY BILL THAT BECAME A LAW PROVIDING FOR  AN  INCREASE  OR  DECREASE  IN
REVENUES  OR MANDATING THE APPROPRIATION OR EXPENDITURE OF MONEYS IN ANY
POLITICAL SUBDIVISION AND FROM REGULATORY  IMPACT  STATEMENTS  OF  RULES
PROMULGATED BY THE STATE EDUCATION DEPARTMENT DURING THE PRECEDING YEAR,
IN  ORDER  TO  CALCULATE  THE  CUMULATIVE  COST  TO LOCAL GOVERNMENTS OF
COMPLYING WITH NEW STATE MANDATES. A COPY OF SUCH REPORT SHALL BE  FILED
WITH  THE  SENATE  FINANCE  COMMITTEE  AND  THE  ASSEMBLY WAYS AND MEANS
COMMITTEE AND COPIES  SHALL  BE  AVAILABLE  TO  ANY  STATE  AGENCY  UPON
REQUEST.
  S 3. This act shall take effect immediately.
