BILL NUMBER: S6964 TITLE OF BILL : An act to amend the public authorities law, in relation to the science and technology law center; and to repeal section 209-q of the executive law, relating to the science and technology law center PURPOSE OR GENERAL IDEA OF BILL : To recodify the science and technology law center from the executive law to the public authorities law and to establish the technology commercialization clinic. SUMMARY OF SPECIFIC PROVISIONS : The legislation would establish the technology commercialization clinic administered by the New York state foundation for science, technology and innovation (NYSTAR) and managed by the science and technology law center for the purposes of assisting universities, entrepreneurs and companies in the state in commercializing new products and processes. Entities eligible to operate the clinics would be competitively selected and would include business, law and engineering schools and other academic research entities located at colleges and universities in the state. Students supervised by appropriate faculty and university administrators would conduct such activities as engaging in research and analysis of the commercial development of early-stage technologies and providing research and

VALESKY -- read twice and ordered printed, and when printed to be committed to the Committee on Commerce, Economic Devel- opment and Small Business AN ACT to amend the public authorities law, in relation to the science and technology law center; and to repeal section 209-q of the execu- tive law, relating to the science and technology law center THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public authorities law is amended by adding two new sections 3102-f and 3102-g to read as follows: S 3102-F. SCIENCE AND TECHNOLOGY LAW CENTER. 1. THE FOUNDATION SHALL, SUBJECT TO AVAILABLE APPROPRIATIONS, ISSUE A REQUEST FOR PROPOSALS TO NEW YORK LAW SCHOOLS TO ESTABLISH THE SCIENCE AND TECHNOLOGY LAW CENTER. 2. THE SCIENCE AND TECHNOLOGY LAW CENTER WILL ADVISE THE FOUNDATION, CENTERS FOR ADVANCED TECHNOLOGY AND OTHER ACADEMIC INSTITUTIONS ON ALL TECHNOLOGY-RELATED LEGAL ISSUES, AND PROVIDE ANY OTHER SERVICES DEEMED NECESSARY BY THE FOUNDATION, INCLUDING BUT NOT LIMITED TO: (A) CONDUCTING RESEARCH ON LEGISLATION, REGULATIONS AND LEGAL DECI- SIONS THAT IMPACT THE FLOW OF TECHNOLOGY TRANSFER AND ACADEMIC RESEARCH; (B) WORKING WITH THE CENTERS FOR ADVANCED TECHNOLOGY AND OTHER ACADEM- IC INSTITUTIONS TO PROVIDE APPROPRIATE ASSISTANCE; (C) WORKING DIRECTLY WITH STARTUP AND EARLY STAGE TECHNOLOGY COMPANIES OUTSIDE OF INSTITUTIONAL SETTINGS; (D) WORKING WITH THE CENTERS IN CREATING AND HOSTING VENTURE CAPITAL FAIRS; (E) MANAGING THE FUNCTIONS OF THE TECHNOLOGY COMMERCIALIZATION CLINIC PROGRAM AS ESTABLISHED PURSUANT TO SECTION THIRTY-ONE HUNDRED TWO-G OF THIS ARTICLE. S 3102-G. TECHNOLOGY COMMERCIALIZATION CLINIC PROGRAM. THE FOUNDATION SHALL ESTABLISH A TECHNOLOGY COMMERCIALIZATION CLINIC PROGRAM TO BE MANAGED BY THE SCIENCE AND TECHNOLOGY LAW CENTER FOR THE PURPOSES OF ASSISTING NEW YORK UNIVERSITIES, ENTREPRENEURS AND COMPANIES IN COMMER- CIALIZING NEW PRODUCTS OR PROCESSES.
