BILL NUMBER: S7381 TITLE OF BILL : An act to amend the public authorities law, in relation to contracts for minority and women owned businesses PURPOSE OR GENERAL IDEA OF BILL : Provides that the thruway authority may award contracts under one hundred thousand dollars to minority and women owned businesses without competitive bidding. SUMMARY OF SPECIFIC PROVISIONS : The New York State Thruway Authority shall award work contracts to the lowest bidder, provided, however that contracts not exceeding $100,000 awarded to a minority or women owned business are exempt from competitive bidding. JUSTIFICATION : This legislation will help to eliminate the barriers and level the playing field for minority and women-owned business enterprises (MWBE) when the New York State Thruway Authority awards contracts. PARKER -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the public authorities law, in relation to contracts for minority and women owned businesses THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 359 of the public authorities law, as amended by chapter 766 of the laws of 1992, is amended to read as follows: 1. On assuming jurisdiction of a thruway section or connection or any part thereof, or of a highway connection, or of the New York state canal system, the authority shall proceed with the construction, recon- struction or improvement thereof. All such work shall be done pursuant to a contract or contracts which shall be let to the lowest responsible bidder, by sealed proposals publicly opened, after public advertisement and upon such terms and conditions as the authority shall require; PROVIDED, HOWEVER, THAT CONTRACTS NOT EXCEEDING ONE HUNDRED THOUSAND DOLLARS AWARDED TO A MINORITY OR WOMEN OWNED BUSINESS AS DEFINED IN SUBDIVISION THREE OF SECTION TWO THOUSAND EIGHT HUNDRED SEVENTY-NINE OF THIS CHAPTER ARE NOT SUBJECT TO COMPETITIVE BIDDING; provided, FURTHER however, that the authority may reject any and all proposals and may advertise for new proposals, as herein provided, if in its opinion, the best interests of the authority will thereby be promoted; provided further, however, that at the request of the authority, all or any portion of such work, together with any engineering required by the authority in connection therewith, shall be performed by the commission- er and his subordinates in the department of transportation as agents for, and at the expense of, the authority.
