BILL NUMBER: S7627 REVISED 05/04/10 TITLE OF BILL : An act to authorize the village of Upper Brookville to expend trust funds to provide access to a park PURPOSE : The bill authorizes the Village of Upper Brookville to expend certain funds from the recreation site and improvement fund for the repair of Donna Drive to provide access to a passive park. SUMMARY OF PROVISIONS : Authorizes the Village of Upper Brookville to expend certain funds from the recreation, site and improvement fund for the repair of Donna Drive. The expenditure will only be made following a majority vote of the Board of Trustees of the Village of Upper Brookville and will not exceed $200,000. JUSTIFICATION : The Village of Upper Brookville seeks to utilize funds from the recreation, site and improvement fund for the repair and extensive rebuilding of Donna Drive. The road is in a state of disrepair and needs to be refurbished so that it can be used to safely access and

MARCELLINO -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to authorize the village of Upper Brookville to expend trust funds to provide access to a park THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law, the village of Upper Brookville, town of Oyster Bay, county of Nassau is hereby author- ized to expend trust funds from the recreation site and improvement fund of such village for the repair, renovation and restoration of a portion of Donna Drive to provide appropriate accesses to a passive park. Such expenditure of trust funds shall be made by majority vote of the board of trustees of the village of Upper Brookville and shall not exceed a total of two hundred thousand dollars ($200,000).
