AN ACT to amend the environmental conservation law, in relation  to  the
  creation  of  a geographic information system-based display to provide
  high-volume hydraulic fracturing information

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Section  23-0309 of the environmental conservation law is
renumbered section 23-0315 and a new section 23-0309 is added to read as
follows:
S 23-0309. GEOGRAPHIC INFORMATION SYSTEM-BASED DISPLAY.
  1.  THE  DEPARTMENT   SHALL   ESTABLISH   A   GEOGRAPHIC   INFORMATION
SYSTEM-BASED  DISPLAY,  WHICH  SHALL INDICATE THE LOCATIONS OF PERMITTED
WELLS FOR HIGH-VOLUME HYDRAULIC FRACTURING, THE LOCATION OF PUBLIC WATER
SUPPLY WELLS AND INTAKES, AND THE STAGE  OF  THE  HIGH-VOLUME  HYDRAULIC
FRACTURING OPERATION FOR EACH PERMITTED WELL; INCLUDING, BUT NOT LIMITED
TO, THE APPROXIMATE PERCENTAGE OF THE REQUIRED WATER FOR HYDRAULIC FRAC-
TURING FLUID THAT HAS BEEN ACCESSED AND STORED ON SITE, WHETHER HIGH-VO-
LUME  HYDRAULIC  FRACTURING  IS  IN  PROGRESS,  AND WHETHER GAS IS BEING
COLLECTED.
  2. SUCH INFORMATION SHALL BE UPDATED  WEEKLY  AND  SHALL  BE  PUBLICLY
ACCESSIBLE ON THE DEPARTMENT'S WEBSITE.
  3. FOR PURPOSES OF THIS SECTION, "HIGH-VOLUME HYDRAULIC FRACTURING" OR
"(HVHF)"  MEANS  HYDRAULIC  FRACTURING  FOR NATURAL GAS EXTRACTION USING
GREATER THAN THREE HUNDRED  THOUSAND  GALLONS  OF  WATER  REGARDLESS  OF
WHETHER THE WELL IS VERTICAL, DIRECTIONAL OR HORIZONTAL.
  S 2. This act shall take effect on the one hundred twentieth day after
it  shall have become a law. Effective immediately, the addition, amend-
ment and/or repeal of any rule or regulation necessary for the implemen-
tation of this act on its effective date are authorized to be made on or
before such effective date.
