BILL NUMBER:S1441 TITLE OF BILL: An act to amend the penal law, in relation to unlawful possession of a knife upon school grounds PURPOSE: This act would make it unlawful for any person age sixteen or older to knowingly possess a knife in an educational institution. SUMMARY OF PROVISIONS: Section one amends Section 265.06 of the Penal law by adding knives among dangerous weapons prohibited in or on the grounds of any school, college or university, without written authorization of such educational institutions, by those persons over the age of sixteen. JUSTIFICATION: Creating and maintaining a safe learning environment is essential. While educational institutions remain among the safest places for young people, instances of violence among high school students have been on the rise. Current law makes it unlawful for any person age sixteen or younger to possess any type of air gun or dangerous knife in or upon a building or grounds used for educational purposes, of any school, college or university, without the written authorization of such educational institution. with regard to those persons age

BRESLIN, ADAMS, KRUEGER, SAMPSON -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to unlawful possession of a knife upon school grounds THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 265.06 of the penal law, as added by chapter 268 of the laws of 1994, is amended to read as follows: S 265.06 Unlawful possession of a weapon upon school grounds. It shall be unlawful for any person age sixteen or older to knowingly possess any KNIFE, air-gun, spring-gun or other instrument or weapon in which the propelling force is a spring, air, piston or CO2 cartridge in or upon a building or grounds, used for educational purposes, of any school, college or university, without the written authorization of such educational institution. Unlawful possession of a weapon upon school grounds is a violation. S 2. This act shall take effect on the ninetieth day after it shall have become a law.
