BILL NUMBER:S2388A

TITLE OF BILL:
An act
to amend the vehicle and traffic law, in relation to the registration of
vintage snowmobiles

PURPOSE:
To require vintage snowmobiles that are used for
participation in club activities, exhibits, tours, parades,
occasional transportation and similar uses, but not used for general
snowmobiling purposes, to pay a reduced portion of the snowmobile
registration fee that is deposited into the Snowmobile Trail
Development and Maintenance Fund.

SUMMARY OF PROVISIONS:
Section 1: Required vintage snowmobiles that
are used only for participation in club activities, exhibits, tours,
parades, occasional transportation and similar uses, but not used for
general snowmobiling purposes, to pay ten dollars annually if the
registrant is a member of an organized club, and twenty dollars
annually if the registrant is not a member of an organized club. The
fees are a reduced portion of the snowmobile registration fee that is
deposited into the Snowmobile Trail Development and Maintenance Fund.

Section 2: Requires that the registration stickers for vintage
snowmobiles be of a different color than other registration stickers
for snowmobiles. The registration sticker is not required to be
affixed to the snowmobile, but must be readily available to the
operator and presented on demand by a law enforcement officer.

Section 3: Defines a vintage snowmobile as any snowmobile manufactured
more than thirty years prior to the current calendar year, or any
other model, year and type snowmobile which has unique
characteristics and is determined by the commissioner to be of
historical; classic, or exhibition value.

Section 4: A person who owns or operates a snowmobile which is
registered as a vintage snowmobile and such snowmobile is not a
vintage snowmobile as defined shall be subject to a fine of$200.

EXISTING LAW:
The current snowmobile registration fee is $45 for New
York State Snowmobile Association (NYSSA) members and $100 for
non-members.

JUSTIFICATION:
Requiring individuals who use their vintage snowmobiles
for participation in club activities, exhibits, tours, parades,
occasional transportation and similar uses, but do not use them for
general snowmobile purposes to pay into the Snowmobile Trail

Development and Maintenance Fund is unfair, as these individuals do
not use the trail system.

LEGISLATIVE HISTORY:
S.3042 of 2009-10.

FISCAL IMPLICATIONS:
Unknown at this time.

EFFECTIVE DATE:
90 days after becoming a law.
