TITLE OF BILL:
An act
to amend the environmental conservation law, in relation to including
issuance of and modification of zoning ordinances and regulations within
the definition of the term "actions" for purposes of environmental
quality review

PURPOSE:
To ensure that local zoning decisions fully consider all the
environmental ramifications of zoning ordinances changes.

SUMMARY OF PROVISIONS:
Amends the State Environmental
Quality Review
Act (SEQRA) of the Environmental Conservation law to include the
issuance of and modifications of zoning ordinances and regulations
under the definition of actions.

EXISTING LAW:
Existing law includes under the definition of "action"
policy, regulations, and procedure-making.

JUSTIFICATION:
Simple land use changes in zoning
ordinances can have
profound effects on the natural and built environment. Increasing the
density of housing can effect the capacity of both the public sewer
treatment plant and the drinking water treatment facilities. Other
zoning modifications can effect stormwater runoff, preservation of
open space and the preservation of wetlands.

  vation

AN ACT to amend the  environmental  conservation  law,  in  relation  to
  including  issuance of and modification of zoning ordinances and regu-
  lations within the definition of the term "actions"  for  purposes  of
  environmental quality review

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Paragraph (ii) of subdivision 4 of section  8-0105  of  the
environmental conservation law, as amended by chapter 228 of the laws of
1976, is amended to read as follows:
  (ii) policy, regulations, and procedure-making, INCLUDING THE ISSUANCE
OR MODIFICATION OF ZONING ORDINANCES AND REGULATIONS.
  S 2. This act shall take effect immediately.
