TITLE OF BILL:
An act
to amend the public buildings law and the public health law,
in relation to enacting the "automated external defibrillators access
act"

PURPOSE OR GENERAL IDEA OF BILL:
To require owners or operators of
stadiums, arenas or convention centers to be equipped with and
maintain automated external defibrillators.

SUMMARY OF SPECIFIC PROVISIONS:
This bill amends § 3 of the public buildings law by adding a new
subdivision 16 which requires large stadiums, arenas and convention
centers in major cities to equip, maintain and provide automated
external defibrillator equipment. This bill also amends the public
health law by adding a new section 3000-e which requires the
employees of such facilities to be trained in the use and operation
of automated external defibrillators by a nationally-recognized
organization.

JUSTIFICATION:
Heart attacks are one of the nation's leading causes of death.
Approximately 250,000 people die from sudden cardiac arrest every

year. The odds of surviving such an attack in New York City are less
than 2%. Every minute that passes without defibrillation, reduces a
victims chance of survival by 10%.
The key to survival is the speed of the response. Automated external
defibrillators greatly increase a heart attack victim's chance of
survival.
The American Heart Association estimates that as many as 100,000
deaths could be prevented each year through the widespread deployment
of defibrillators.
Seconds are critical when an individual suffers a heart attack. It is
essential that the State encourage businesses to invest in life
saving equipment. For that reason, automated external defibrillators
need to be readily available in large public buildings.

To be determined.

EFFECTIVE DATE:
This act shall take effect on the one hundred
eightieth day after it shall have become a law; provided, however
that effective immediately, the addition, amendment and/or repeal of
any rule or regulation necessary for the implementation of this act
on its effective date are authorized and directed to be made and
completed on or before such effective date.

AN ACT to amend the public buildings law and the public health  law,  in
  relation  to  enacting  the  "automated external defibrillators access
  act"

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Short  title. This act shall be known and may be cited as
the "automated external defibrillators access act".
  S 2.  Section 3 of the public buildings law is amended by adding a new
subdivision 16 to read as follows:
  16. IN CITIES WITH A POPULATION OF OVER ONE MILLION,  EQUIP,  MAINTAIN
AND  PROVIDE  AUTOMATED  EXTERNAL DEFIBRILLATOR EQUIPMENT, AS DEFINED IN
PARAGRAPH (A) OF SUBDIVISION ONE OF  SECTION  THREE  THOUSAND-B  OF  THE
PUBLIC HEALTH LAW, IN QUANTITIES DEEMED ADEQUATE BY THE DEPARTMENT. SUCH
EQUIPMENT  SHALL  BE  READILY ACCESSIBLE FOR USE DURING MEDICAL EMERGEN-
CIES. ANY INFORMATION DEEMED NECESSARY BY THE COMMISSIONER SHALL  ACCOM-
PANY  SUCH  EQUIPMENT. THE COMMISSIONER SHALL ESTABLISH TRAINING COURSES
BY A NATIONALLY-RECOGNIZED ORGANIZATION, AS DEFINED IN PARAGRAPH (D)  OF
SUBDIVISION  ONE  OF  SECTION THREE THOUSAND-B OF THE PUBLIC HEALTH LAW,
FOR THOSE INDIVIDUALS WHOM THE COMMISSIONER DEEMS SHALL  BE  TRAINED  IN
THE USE OF SUCH AUTOMATED EXTERNAL DEFIBRILLATOR EQUIPMENT.
  S  3.  The public health law is amended by adding a new section 3000-e
to read as follows:
  S 3000-E. AUTOMATED  EXTERNAL  DEFIBRILLATORS;  STADIUMS,  ARENAS  AND
CONVENTION  CENTERS  IN CITIES WITH A POPULATION OF OVER ONE MILLION. IN
CITIES WITH A POPULATION OF OVER ONE MILLION, ALL STADIUMS,  ARENAS  AND
CONVENTION  CENTERS  WITH  OCCUPANCIES  OF  OVER  FIVE THOUSAND SHALL BE
EQUIPPED WITH AND MAINTAIN AUTOMATED EXTERNAL DEFIBRILLATORS AS  DEFINED
IN  PARAGRAPH (A) OF SUBDIVISION ONE OF SECTION THREE THOUSAND-B OF THIS

 EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                      [ ] is old law to be omitted.

ARTICLE. EMPLOYEES OF SUCH STADIUMS, ARENAS OR CONVENTION CENTERS  SHALL
BE  TRAINED BY A NATIONALLY-RECOGNIZED ORGANIZATION, AS DEFINED IN PARA-
GRAPH (D) OF SUBDIVISION ONE OF SECTION THREE THOUSAND-B OF  THIS  ARTI-
CLE.  THE  OWNERS  OR  OPERATORS  OF SUCH STADIUMS, ARENAS OR CONVENTION
CENTERS SHALL PROVIDE SUCH AUTOMATED EXTERNAL DEFIBRILLATORS IN  QUANTI-
TIES DEEMED NECESSARY BY THE COMMISSIONER. SUCH EQUIPMENT SHALL BE READ-
ILY  ACCESSIBLE  FOR  USE  DURING  MEDICAL  EMERGENCIES. ANY INFORMATION
DEEMED NECESSARY BY THE COMMISSIONER SHALL ACCOMPANY SUCH EQUIPMENT.
  S 4. This act shall take effect on the one hundred eightieth day after
