TITLE OF BILL:
An act
to amend the elder law, in relation to authorizing certain
county operated NY Connects: Choices for
Long Term Care programs to participate in a universal assessment
demonstration program

PURPOSE OR GENERAL IDEA OF BILL:
Creates a universal assessment demonstration program within the state
office for the aging.

SUMMARY OF SPECIFIC PROVISIONS:
Adds a new subdivision to the Elder law, which requires the director of
the state office for the aging to select one or more county operators of
the NY Connect Program to develop a universal assessment system for
determining the appropriate level of care for older new Yorkers seeking
long term care. The director must establish criteria for good standing
for program participants, based on the ability of participants to assist
in this demonstration program and complete the assessment process.
Specifically, the assessment should target individuals who are
identified by NY Connects Programs as needing respite care, home
delivered meals, and in-home services provided by the aging network, as
well as licensed home and community services and nursing home level of
care.

JUSTIFICATION:
New York's long term care system has a wide range of inter-connected
services and programs. A uniform assessment system is necessary to
provide appropriate long term care to New Yorkers. The state's home and
community-based programs lack standardization and common language. Thus,
the demonstration program created by this legislation seeks to provide
an assessment of the functional needs of patients seeking long term
care. For individuals in need of long term care services, navigating New
York State's long term care system can be challenging and a universal
assessment system will help create standardization in determining the
appropriate level of long term care.

PRIOR LEGISLATIVE HISTORY:
This is a new bill.

FISCAL IMPLICATIONS:
No additional cost to the state. Funding provided in this year's budget
as part of the universal assessment program shall be sub-allocated by
the Department of Health to support the program's administration.

EFFECTIVE DATE:
90 days after the bill becomes law.

AN ACT to amend the elder law, in relation to authorizing certain county
  operated NY Connects: Choices for Long Term Care programs  to  partic-
  ipate in a universal assessment demonstration program

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 8 of section 203 of the elder law, as added  by
section  18  of  part B of chapter 58 of the laws of 2007, is renumbered
subdivision 9 and a new subdivision 10 is added to read as follows:
  10. THE  DIRECTOR,  SHALL  SELECT  ONE  OR  MORE  COUNTY  OPERATED  NY
CONNECTS:  CHOICES  FOR  LONG  TERM CARE THAT ARE DETERMINED ELIGIBLE TO
PARTICIPATE IN THE UNIVERSAL ASSESSMENT DEMONSTRATION PROGRAM.  PROGRAMS
ELIGIBLE  TO  PARTICIPATE MUST BE IN GOOD STANDING ACCORDING TO CRITERIA
ESTABLISHED BY THE DIRECTOR WHICH IS BASED ON ITS CAPACITY TO BE ABLE TO
ASSIST IN THIS DEMONSTRATION AND COMPLETE THE ASSESSMENT  PROCESS  USING
THE TOOLS ESTABLISHED AS PART OF THE UNIVERSAL ASSESSMENT PROGRAM FUNDED
PURSUANT TO CHAPTER FIFTY-THREE OF THE LAWS OF TWO THOUSAND ELEVEN. THIS
DEMONSTRATION SHALL TARGET THE ASSESSMENT OF INDIVIDUALS WHO ARE IDENTI-
FIED  BY  NY  CONNECTS AS POTENTIALLY IN NEED OF RESPITE, HOME DELIVERED
MEALS, AND IN-HOME SERVICES PROVIDED BY THE AGING NETWORK  AND  LICENSED
HOME  AND  COMMUNITY  SERVICES  AND  NURSING HOME LEVEL OF CARE. FUNDING
SHALL BE SUB-ALLOCATED BY THE DEPARTMENT OF HEALTH TO THE STATE FOR  THE
PURPOSE  OF  SUPPORTING  THE  ADMINISTRATION  OF  THE  ASSESSMENT  BY NY
CONNECTS AND IMPLEMENTATION  OF  MODIFICATIONS  NEEDED  TO  IMPROVE  THE
DESIGN AND FUNCTION OF THIS ASSESSMENT TOOL.
  S  2.  This  act shall take effect on the ninetieth day after it shall
have become a law. Effective immediately, the addition, amendment and/or
repeal of any rule or regulation necessary  for  the  implementation  of
this  act  on  its effective date are authorized and directed to be made
and completed on or before such effective date.
