BILL NUMBER:S5454 TITLE OF BILL: An act to amend the criminal procedure law, in relation to security services in the courts PURPOSE OR GENERAL IDEA OF BILL: To authorize the inclusion of Monroe County Sheriff deputies as sheriff court security SUMMARY OF SPECIFIC PROVISIONS: Section 1. Subdivision 21 of section 2.10 of the criminal procedure law is amended by adding a new paragraph g to allow a deputy sheriff who is employed by the sheriff's department of Monroe county to perform the delivery of security services to the courts. JUSTIFICATION: The New York State Office of Court Administration (OCA) contracts and pays for court security personnel in the Hall of Justice, Rochester, New York. OCA requires that all such personnel be certified and registered with the Bureau of Municipal Police. OCA has recommended Monroe County to seek special legislation to allow county sheriff deputies to perform court security services

NOZZOLIO -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the criminal procedure law, in relation to security services in the courts THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 21 of section 2.10 of the criminal procedure law is amended by adding a new paragraph g to read as follows: G. NOTWITHSTANDING THE PROVISIONS OF PARAGRAPH (B) OF SUBDIVISION THIRTY-FOUR OF SECTION 1.20 OF THIS CHAPTER, A DEPUTY SHERIFF CURRENTLY OR IN THE FUTURE EMPLOYED BY THE SHERIFF'S DEPARTMENT OF MONROE COUNTY WHO IS DESIGNATED BY THE SHERIFF TO PERFORM THE DELIVERY OF SECURITY SERVICES TO THE COURTS. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, A DEPUTY SHERIFF CURRENTLY OR IN THE FUTURE EMPLOYED BY THE SHERIFF'S DEPARTMENT OF MONROE COUNTY WHO IS DESIGNATED BY THE SHERIFF TO PERFORM THE DELIVERY OF SECURITY SERVICES TO THE COURTS SHALL BE ELIGIBLE TO PARTICIPATE IN THE TWENTY-FIVE YEAR RETIREMENT PLAN SET FORTH IN SECTION EIGHTY-NINE-N OR EIGHTY-NINE-P OF THE RETIREMENT AND SOCIAL SECURITY LAW, AS THE CASE MAY BE, AND SHALL BE ELIGIBLE TO RECEIVE THE PAYMENT OF SALARY, WAGES, MEDICAL AND HOSPITAL EXPENSES INCURRED IN THE PERFORMANCE OF SUCH DEPUTY SHERIFF'S DUTIES AS SET FORTH IN SECTION TWO HUNDRED SEVEN-C OF THE GENERAL MUNICIPAL LAW. S 2. This act shall take effect on the thirtieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
