TITLE OF BILL:
An act
to amend the education law, in relation to transferring control of the
Yonkers education construction fund board to the mayor of the city of
Yonkers

PURPOSE OR GENERAL IDEA OF BILL:
The purpose of this bill is to transfer control of the Yonkers
Education Construction Fund Board of Trustees to the Mayor of the
City of Yonkers.

SUMMARY OF SPECIFIC PROVISIONS:
Section 1 of the bill amends subdivision 1 of Section 477 of the
education law, as added by Chapter 931 of the laws of 1971 to
include the mayor of the City of Yonkers and the Mayor's appointees
on the Board of Trustees for the City of Yonkers Education
Construction Fund.

The bill provides that the Mayor of the City of Yonkers serves as the
chairperson, of the Yonkers Education Construction Fund. The City
Council President, Majority Leader and Minority Leader shall also
serve on the board. This bill permits the Mayor to appoint four
trustees. Two of the four must be
current members of the Board of Education. The Mayor and his or her
appointees will act in an ex officio capacity during their terms on
the board. The Mayor and city council members shall serve on the
board during their terms in office. All other trustees shall serve at
the pleasure of the Mayor.

Section 2 of the bill is the effective date.

JUSTIFICATION:
Under current law, the former Mayor of the City of Yonkers and his
Board appointees still have voting rights on the City's Education
budget needs. It is necessary to amend the law to allow the current
Mayor of the City of Yonkers control of the Board of Trustees for the
Yonkers Education Construction Fund and input from the City Council.

AN  ACT  to amend the education law, in relation to transferring control
  of the Yonkers education construction fund board to the mayor  of  the
  city of Yonkers

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 1 of section 477 of the education law, as added
by chapter 931 of the laws of 1971, is amended to read as follows:
  1.  There  is  hereby  created  the  "city  of   Yonkers   educational
construction  fund."  The  fund shall be a corporate governmental agency
constituting a public benefit corporation. It shall be administered by a
board of trustees consisting of the [chairman]  MAYOR  OF  THE  CITY  OF
YONKERS,  THE CHAIRPERSON of the board of education of the city of Yonk-
ers, [four members of such board appointed by the president thereof  and
four  members appointed by the mayor of the city of Yonkers.  The chair-
man of the board of education shall be the chairman  of  the  fund.  The
chairman]  THE CITY COUNCIL PRESIDENT, THE CITY COUNCIL MAJORITY LEADER,
THE CITY COUNCIL MINORITY LEADER, AND FOUR  TRUSTEES  APPOINTED  BY  THE
MAYOR OF THE CITY OF YONKERS, TWO OF WHICH SHALL BE MEMBERS OF THE BOARD
OF  EDUCATION  OF THE CITY OF YONKERS. THE MAYOR, THE CHAIRPERSON OF THE
BOARD OF EDUCATION, and the trustees who are members of  the  [board  of
education]  CITY  COUNCIL  shall  serve during their terms of office [as
chairman and members, respectively,  of  the  board  of  education.  The
members  first  appointed by the mayor shall serve for terms ending two,
three, four and  five  years,  respectively,  from  the  date  of  their
appointment.  Their successors shall serve for terms of five years each]
AND THE TRUSTEES APPOINTED BY THE MAYOR SHALL SERVE AT THE  PLEASURE  OF
THE  MAYOR.    THE  FUND  SHALL ELECT ITS OWN CHAIRPERSON FROM AMONG ITS
MEMBERS.
