TITLE OF BILL:
An act
to amend chapter 678 of the laws of 2007 amending the labor law relating
to contracts for public work and building service work, in relation to
making such provisions permanent

PURPOSE OF THE BILL:
This bill extends the ability of the Department
of Labor to enforce the prevailing wage law on public work projects
where contractual relationships with the contractor exists.

SUMMARY OF SPECIFIC PROVISIONS:
§ 1- Amends § 5 of chapter 678 of the laws of 2007 to extend the
effectiveness thereof.

§ 2- Effective date.

JUSTIFICATION:
Present law, which is set to expire October 27, 2012,
provides that the Department of Labor shall enforce Article 8 of the
labor law on public work projects where the involvement of a third
party obviates the existence of a direct contractual relationship
between the public owner and the contractor performing the work, by
providing that such an arrangement constitutes a "contract" for
purposes of the Article.

FISCAL IMPLICATIONS:
None.

EFFECTIVE DATE:
This act shall take effect immediately.

AN  ACT  to amend chapter 678 of the laws of 2007 amending the labor law
  relating to contracts for public work and building  service  work,  in
  relation to making such provisions permanent

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 5 of chapter 678 of the laws of 2007  amending  the
labor  law  relating  to  contracts for public work and building service
work is amended to read as follows:
  S 5. This act shall take effect on the sixtieth  day  after  it  shall
have  become a law, and shall apply to all contracts or other agreements
entered into on or after such date[; and  shall  expire  and  be  deemed
repealed 5 years after such effective date].
  S 2. This act shall take effect immediately.
