TITLE OF BILL:
An act
to amend the vehicle and traffic law, in relation to permitting certain
motor vehicles on a certain segment of public roads

PURPOSE:
This legislation permits commercial vehicles on a section of local
roads within a distance of approximately 1.65 miles of exit 20 of the
New York State Thruway.

SUMMARY OF PROVISIONS
Section 1. Amends subdivision 16 of section 385 of the Vehicle and
Traffic Law to add a new Paragraph v, which would allow vehicle
trailers over forty-eight (48) feet in length to travel on
non-designated local routes in Saugerties, New York.

Section 2. Effective date.

JUSTIFICATION:
Saugerties Furniture Mart, a small business located in the Village of
Saugerties, was recently advised by the New York State Department of
Transportation (DOT - Region 8 Office) that the Department would not
be able to issue a normal waiver for Special Dimension Vehicle Access
to allow fifty-three (53) foot trailers to deliver goods. since the
roads in question are not formally designated for commercial purposes.

Many of the Saugerties Furniture's suppliers have been using
fifty-three (53) foot trailers as a means of shipping goods. DOT had
previously approved a route along State Routes 32, 212, and US Route
9W, which would allow special dimension and commercial vehicles to
travel directly past his business. However, due to technicality in
the law related to lane width, trailers larger than forty-eight (48)
feet in length were prohibited from deviating off that designated
route.

After collaborating with the Ulster County Traffic Safety Board. NYS
DOT. the NYS Police. the Saugerties Police Department, and local
officials, all parties agree this special legislation is the most
appropriate way to address the issue. The request by the Village of
Saugerties for this legislation is pursuant to a letter received 011
June 8, 2012 from Mayor William Murphy.

This business has been operating for 65 years, and as a small business
in the community. it provides significant economic benefit. This
special legislation is intended to provide the necessary relief to
allow the business to continue to receive shipments of goods while
ensuring public safety.

AN ACT to amend the vehicle and traffic law, in relation  to  permitting
  certain motor vehicles on a certain segment of public roads

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 16 of section 385 of the  vehicle  and  traffic
law is amended by adding a new paragraph (v) to read as follows:
  (V)  WITHIN A DISTANCE OF APPROXIMATELY 1.65 MILES FROM EXIT NUMBER 20
OF THE NEW YORK STATE THRUWAY, SUCH DISTANCE TO BE MEASURED IN A  SOUTH-
EASTERLY  DIRECTION  FROM THE POINT WHERE STATE ROUTE 32 INTERSECTS WITH
THE SOUTHBOUND ACCESS RAMP LEADING TO THE NEW YORK STATE THRUWAY, OVER A
ROUTE EXTENDING IN A SOUTHEASTERLY DIRECTION ON STATE ROUTE 32, AND THEN
EASTERLY ALONG US ROUTE 9W FOR A DISTANCE OF APPROXIMATELY  0.14  MILES,
TO  WASHINGTON AVENUE BETWEEN US ROUTE 9W AND RUSSELL STREET, A DISTANCE
OF APPROXIMATELY 0.13 MILES, AND WEST ON RUSSELL STREET BETWEEN WASHING-
TON AVENUE AND THE COTERMINOUS SEGMENT OF US ROUTE 9W  AND  STATE  ROUTE
32,  OTHERWISE KNOWN AS PARTITION STREET IN THE VILLAGE OF SAUGERTIES, A
DISTANCE OF APPROXIMATELY 0.14 MILES.
  S 2. This act shall take effect immediately.
