BILL NUMBER:S827A

TITLE OF BILL:
An act
to amend the insurance law, in relation to motor vehicle insurance
rate reductions for participation in certain anti-theft programs

PURPOSE OR GENERAL IDEA OF BILL:
To enable consumers to receive automobile insurance premium reductions
for the installation of anti-theft devices on their vehicles.

SUMMARY OF SPECIFIC PROVISIONS:
Section 2336 of the insurance law is
amended by adding a new subsection (i) and Section 2342 of the
insurance law as amended by chapter 102 of the laws of 2011 is amended.

Subsection (i) provides for automobile insurance premium reductions
for drivers who are participating in an official police department
program designed to prevent or reduce motor vehicle theft. The rates
will continue to be based on schedules submitted to the
Superintendent of Insurance by the insurers issuing policies.

JUSTIFICATION:
Current law provides for automobile insurance premium reductions for
persons whose vehicles have homing devices or auto glass etching to
aid in the recovery of stolen vehicles. This legislation would expand
this provision to drivers who participate in approved anti-theft
programs. Various anti-theft devices have proven to be deterrents to
auto theft. These include special locks, fuel cut-off devices, alarms
and similar equipment. In addition, a program called the Combat Auto
Theft (C.A.T.) Police Decal Program has substantially reduced theft
among participating motorists in New York City. The plan allows a
police officer to ask for the driver's license and registration of
any individual operating the vehicle between the hours of 1 AM and 5
AM (when most thefts occur).

SUPPORT:
Millions of automobile owners in New York State would be
strong supporters of this legislation, and would benefit from its
provision.

PRIOR LEGISLATIVE HISTORY:
This bill was previously introduced.

FISCAL IMPLICATIONS TO THE STATE:
None.

EFFECTIVE DATE:
This act shall take effect immediately provided that
subsection (i) of section 2336 of the insurance law, added by section
one of this act, shall be subject to, and shall expire in accordance
with, section 2342 of the insurance law, as from time to time amended.
