TITLE OF BILL: An act to amend the education law, in relation to
requiring the commissioner of education to promulgate rules and
regulations requiring that all students in grade five or below remain
at their school unless they are under the supervision of authorized
transportation, a parent or guardian or another authorized person

PURPOSE:

The purpose of this legislation is to ensure the safety of our
children to and from school.

SUMMARY OF PROVISIONS:

Section 1 - Amends section 305 of Education Law by adding a new
subdivision 44. Requires the Commissioner of Education to promulgate
rules and regulations requiring that all students in grade five and
below remain at their school unless they are released under the
supervision of authorized transportation, a parent or guardian or
another authorized person.

Section 2 - Effective Date

EXISTING LAW:

None.

JUSTIFICATION:

In March 2002, a series of reported incidents occurred in Queens
involving pedophiles who molested, exposed themselves or tried to lure
school children into their cars. Several of these incidents involved
elementary school children who were on their way to and from school.
These incidents may have been averted if the children had been
accompanied by an adult or authorized person of responsible age This
legislation will help to ensure the safety of our children.

AN ACT to amend the education law, in relation to requiring the  commis-
  sioner of education to promulgate rules and regulations requiring that
  all students in grade five or below remain at their school unless they
  are  under  the  supervision of authorized transportation, a parent or
  guardian or another authorized person

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 305 of the education law is amended by adding a new
subdivision 44 to read as follows:
  44.  THE  COMMISSIONER  IS AUTHORIZED AND DIRECTED TO PROMULGATE RULES
AND REGULATIONS WHICH REQUIRE THAT ALL STUDENTS WHO ARE IN GRADE FIVE OR
BELOW AND WHO ARE ATTENDING SCHOOL ON A PARTICULAR DAY SHALL  REMAIN  AT
THEIR  SCHOOL BUILDING UNLESS THEY ARE RELEASED UNDER THE SUPERVISION OF
AUTHORIZED TRANSPORTATION, A PARENT OR GUARDIAN  OR  ANOTHER  AUTHORIZED
PERSON.
  S 2. This act shall take effect immediately.
