BILL NUMBER:S2920

TITLE OF BILL: An act to amend section 2 of chapter 314 of the laws of
2012 relating to authorizing the town of East Hampton to alienate and
convey its interest in parkland, jointly owned by the towns of East
Hampton and Southampton, to the town of Southampton, in relation to
metes and bounds; and to repeal certain provisions of such chapter
relating thereto

PURPOSE: This legislation amends Chapter 314 of the Laws of 2012 which
authorized the Town of East Hampton to alienate, transfer and convey its
interest in the Poxabogue Golf Center, jointly owned by the towns of
East Hampton and Southampton, to the town of Southampton by making the
necessary revisions to accurately describe the metes and bounds of the
affected property.

SUMMARY OF PROVISIONS: Section 2 of Chapter 314 of the Laws of 2012 is
repealed and is replaced by a new Section 2 detailing the accurate
description of the land comprising the Poxabogue Golf Center.

JUSTIFICATION:For the past few years, the Town of East Hampton has been
implementing several cost saving measures in order to return to a sound
financial condition. In 2012, legislation was enacted to enable the Town
of East Hampton to alienate, transfer and convey its 50% share in the
Poxabogue Golf Center to the Town of Southampton (Chapter 314 of the
Laws of 2012).

During the transaction process between the two towns, it was determined
that the metes and bounds of the property were incorrectly described in
the newly enacted law. In order for the transaction to move forward, it
is necessary to place in statute the correct coordinates of the land
comprising the Poxabogue Golf Center. This legislation amends Chapter
314 of the Laws of 2012 to accurately describe and detail the coordi-
nates of such land.

LEGISLATIVE HISTORY: 2013: New Legislation

FISCAL IMPLICATIONS: None to the State.

EFFECTIVE DATE: This act shall take effect immediately.
