TITLE OF BILL: An act to amend the criminal procedure law, in
relation to designating village of Lake George seasonal constables as
peace officers

PURPOSE: To provide peace officer status to seasonal employees of the
Village of Lake George who are charged with enforcement of local laws.

SUMMARY OF PROVISIONS:

Section one provides that employees of the village of Lake George
employed as seasonal village constables are hereby designated as peace
officers with the power to issue appearance tickets and simplified
traffic informations for the offenses defined in the code of the
village of Lake George and for offenses designated to be violations in
the statutes of the state These officers are further prohibited from
carrying firearms unless appropriately licensed pursuant to Section
400.00 of the penal law.

Section two contains the effective date.

EXISTING LAW:

Section 2.10 of the criminal procedure law provides for peace officer
designation.

JUSTIFICATION: The village of Lake George hires 15-20 individuals
each summer season to patrol their streets, enforce local laws and
direct traffic. This seasonal program won the 2003 Local Government
Achievement award and as resulted in saving the community thousands of
dollars annually. This legislation has been introduced at the request
of the village of Lake George in order to ensure the safety or
residents and tourists in Lake George during the busy tourist season.

FISCAL IMPLICATIONS: None to the State

LOCAL FISCAL IMPLICATIONS: Enactment will result in annual savings of
$400,000 to $600,000 to the village of Lake George.

EFFECTIVE DATE: This act shall take effect immediately.

AN  ACT  to amend the criminal procedure law, in relation to designating
  village of Lake George seasonal constables as peace officers

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Section  2.10 of the criminal procedure law is amended by
adding a new subdivision 84 to read as follows:
  84.  SEASONAL VILLAGE CONSTABLES OF THE VILLAGE OF LAKE GEORGE FOR THE
PURPOSES OF ISSUING APPEARANCE TICKETS AND SIMPLIFIED  TRAFFIC  INFORMA-
TIONS FOR OFFENSES DEFINED IN THE CODE OF THE VILLAGE OF LAKE GEORGE AND
FOR  OFFENSES  DESIGNATED TO BE VIOLATIONS IN THE STATUTES OF THE STATE;
PROVIDED, HOWEVER, THAT NOTHING IN THIS SUBDIVISION SHALL BE  DEEMED  TO
AUTHORIZE SUCH OFFICER TO CARRY, POSSESS, REPAIR OR DISPOSE OF A FIREARM
UNLESS  THE  APPROPRIATE  LICENSE  THEREFOR  HAS BEEN ISSUED PURSUANT TO
SECTION 400.00 OF THE PENAL LAW.
  S 2. This act shall take effect immediately.
