BILL NUMBER:S3602

TITLE OF BILL: An act to amend the penal law, in relation to unauthor-
ized release of personal data

PURPOSE: Relates to the unauthorized release of certain personal iden-
tifying information.

SUMMARY OF PROVISIONS:

Section one amends the penal law by adding a new section 190.87, unau-
thorized release of personal data.

Section two is the effective date.

JUSTIFICATION: Releasing personal identifying information to the public
is a very serious matter. Particularly with the advent of the Internet
and other recent technological advances, it is easier than ever for
copious amounts of people to view information quickly. Disseminating
personal identifying information creates widespread opportunity for
identity theft, a crime with devastating financial consequences that has
been on the rise in recent years. The bill makes unauthorized release of
personal identifying information a class E felony.

LEGISLATIVE HISTORY: 2012: S.7846 - Referred to Rules.

FISCAL IMPLICATIONS: None.

EFFECTIVE DATE: This act shall take effect on the first of November
next succeeding the date on which it shall have become a law.
