BILL NUMBER:S3636A

TITLE OF BILL: An act to amend the county law, in relation to
allowing Ontario county to participate in the Foreign Trade Zone
program

PURPOSE OR GENERAL IDEA OF BILL: Authorizes the county of Ontario to
apply to the federal government to establish, operate and maintain a
foreign trade zone or zones and foreign trade sub-zone or sub-zones
within such county, and adjacent counties of Livingston, Wayne,
Seneca, Yates, and Steuben.

SUMMARY OF SPECIFIC PROVISIONS: Section 1. Amends Section 224 of the
County Law by adding a new subdivision 28 to allow for the County of
Ontario to make application to the Foreign Trade Zones Board
established by Congress.

Section 2. Contains the effective date.

JUSTIFICATION: Numerous companies within Ontario County expressed
interest in having access to Foreign Trade Zone (FTZ) benefits. The
Ontario County Economic Development Corporation (OCEDC) recognized the
need for FTZ status in Ontario County by passing a resolution to apply
for FTZ grantee status under an Alternative Site Framework (ASF) on
August 21, 2012.

The Counties of Wayne, Yates, Seneca, Steuben and Livingston have
expressed a desire to join OCEDC's application for FTZ grantee status.

The Ontario County Board of Supervisors supports OCEDC's application
for FTZ grantee status and passed resolution NO. 868-2012 on December
21, 2012 requesting that this enabling legislation be adopted.

The establishment of a new Zone under ASF will help the region serve
the trade-related needs of businesses by providing the proposed
Grantee with the efficiency and flexibility in serving prospective
users at the speed of business. It will bring job opportunities to the
area, encourage the development of other businesses and further expand
the area's logistics status. By creating a more business friendly
environment, the retention, expansion and relocation of businesses
will naturally occur. The resulting economic impact will yield two
positive results: added household earnings and an additional tax base
for the funding of public project expansion and modernization.

PRIOR LEGISLATIVE HISTORY: This is a new bill.

FISCAL IMPLICATIONS: None.

EFFECTIVE DATE: This act shall take effect immediately.

AN ACT to amend the county law, in relation to allowing  Ontario  county
  to participate in the Foreign Trade Zone program

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 224 of the county law is amended by  adding  a  new
subdivision 28 to read as follows:
  28.  THE  COUNTY  OF ONTARIO MAY MAKE APPLICATION TO THE FOREIGN TRADE
ZONES BOARD ESTABLISHED BY THE ACT  OF  CONGRESS,  APPROVED  JUNE  EIGH-
TEENTH,  NINETEEN  HUNDRED  THIRTY-FOUR, ENTITLED "AN ACT TO PROVIDE FOR
THE ESTABLISHMENT, OPERATION AND MAINTENANCE OF FOREIGN TRADE  ZONES  IN
PORTS  OF  ENTRY OF THE UNITED STATES, TO EXPEDITE AND ENCOURAGE FOREIGN
COMMERCE, AND FOR OTHER PURPOSES," FOR A GRANT TO ONTARIO COUNTY OF  THE
PRIVILEGE  TO  HAVE ESTABLISHED, OPERATED AND MAINTAINED A FOREIGN TRADE
ZONE OR ZONES AND FOREIGN TRADE SUB-ZONE OR SUB-ZONES WITHIN SUCH  COUN-
TY,  AND ADJACENT COUNTIES OF LIVINGSTON, WAYNE, SENECA, YATES AND STEU-
BEN PURSUANT TO THE PROVISIONS OF SUCH ACT, AND IF SUCH  APPLICATION  BE
GRANTED,  TO HAVE ESTABLISHED, OPERATED AND MAINTAINED SUCH ZONE OR SUB-
ZONE IN ACCORDANCE WITH LAW. THE COUNTY OF ONTARIO MAY ENTER  INTO  SUCH
CONTRACTS  AND MAY APPROPRIATE SUCH SUMS OF MONEY AS IT MAY DEEM PROPER,
SUBJECT TO THE PROVISIONS OF THIS ARTICLE,  TOWARDS  THE  PROMOTION  AND
ESTABLISHMENT OF SUCH ZONES.
  S 2. This act shall take effect immediately.
