BILL NUMBER:S4494A

TITLE OF BILL: An act to amend the general business law, in relation
to exempting retired federal agents and border patrol agents from
training requirements for security guards

PURPOSE:

To exempt retired Federal Agents and Border Patrol Agents from
security guard training requirements provided that such individual
provides proof of training substantially similar to the training
required by law.

SUMMARY OF PROVISIONS:

Section 1 of the bill amends section 89-n of the general business law
to include retired Federal Agents and Border Patrol Agents as exempt
from the security guard training requirements, if they provide proof
of completion of training substantially similar to the training
required by law.

Section 2 of the bill is the effective date.

JUSTIFICATION:

Currently, certain qualified and properly trained professionals are
exempt from security guard training requirements. These professionals
may include certain correction officers, bridge and tunnel officers,
court officers, court clerks, and certain retired police and peace
officers. However, retired federal agents or border patrol agents are
not exempt from such security guard training requirements. These
federal agents possess years of valuable experience, and in many cases
can demonstrate similar training to the standard of training required
by law. The costs of completing training requirements can dissuade
highly qualified retired federal agents from becoming security guards.
This bill will allow retired federal agents to continue serving in a
role of safety and protection without having to duplicate costly
training.

PRIOR. LEGISLATIVE HISTORY:

S6521 (2012) referred to Consumer Protection Committee.

FISCAL IMPLICATIONS:

None.

EFFECTIVE DATE:

This act shall take effect immediately.
