TITLE OF BILL: An act to amend the transportation law, in relation to
providing for the erection of a sound barrier to abate highway
generated noise on a section of the Sprain Brook parkway

PURPOSE OR GENERAL IDEA OF BILL:

The purpose of this bill is to provide for the erection of physical
barriers on portions of the Sprain Brook Parkway to effectively screen
the sound of motor vehicles.

SUMMARY OF SPECIFIC PROVISIONS:

Section 1 - amends the transportation law by adding a new subdivision
4. The Commissioner shall provide for the timely construction and
erection of one or more physical barriers on the Sprain Brook Parkway
to effectively screen the sound of motor vehicles and abate highway
generated noise from such locations. The construction of such physical
barriers shall, to the extent practicable, be consistent with the
recommendations of the department of transportation project DO 1 0268,
PIN S060.02.101 Section 1, subdivision a lists the various locations
recommended for the erection of physical barriers.

JUSTIFICATION:

The locations on the Sprain Brook Parkway which this bill would affect
contains residential areas and housing complexes in close proximity to
the Parkway. There are houses which predate the existence of the
Parkway. Many of the houses affected were constructed in the 1940s.
The Sprain Parkway was constructed in the 1960s, however, it only
extended to Jackson Avenue which is located before the area in
question. It was not until the 1970s that the Parkway was expanded and
transformed into a major freeway. Since then existence of the Parkway
has undergone numerous expansions which have increased the severity of
this problem. Shoulders were added to the Parkway, bringing it eight
feet closer to the preexisting homes.

AN ACT to amend the transportation law, in relation to providing for the
  erection of a sound barrier to abate  highway  generated  noise  on  a
  section of the Sprain Brook parkway

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 70 of the transportation law is amended by adding a
new subdivision 4 to read as follows:
  4. THE COMMISSIONER SHALL PROVIDE  FOR  THE  TIMELY  CONSTRUCTION  AND
ERECTION  OF ONE OR MORE PHYSICAL BARRIERS ON THE SOUTHBOUND SIDE OF THE
SPRAIN BROOK PARKWAY BEGINNING FROM THE STATE  MAINTENANCE  FACILITY  ON
WEST  GRASSY  SPRAIN  ROAD  AND RUNNING THENCE SOUTHERLY TO THE TUCKAHOE
ROAD EXIT AND ON THE NORTHBOUND SIDE OF THE SPRAIN BROOK PARKWAY  BEGIN-
NING  FROM PALMER ROAD AND RUNNING THENCE NORTHERLY TO CENTRAL AVENUE IN
THE CITY OF YONKERS, TO EFFECTIVELY SCREEN THE SOUND OF  MOTOR  VEHICLES
AND ABATE HIGHWAY GENERATED NOISE FROM SUCH LOCATIONS.  THE CONSTRUCTION
OF  SUCH PHYSICAL BARRIERS SHALL, TO THE EXTENT PRACTICABLE, BE CONSIST-
ENT WITH THE RECOMMENDATIONS OF  DEPARTMENT  OF  TRANSPORTATION  PROJECT
REPORT D010268, PIN S060.02.101.
  (A)  THE  PHYSICAL  BARRIERS  AUTHORIZED  BY  THIS  SUBDIVISION  TO BE
CONSTRUCTED ON THE SOUTHBOUND SIDE OF THE  SPRAIN  BROOK  PARKWAY  SHALL
INCLUDE CONSTRUCTION OF:
  (I)  A  THREE  THOUSAND  ONE HUNDRED THIRTY FEET LONG AND SIXTEEN FEET
HIGH PHYSICAL BARRIER BETWEEN THE SOUTHERN END OF SPRAIN RIDGE PARK  AND
TUCKAHOE ROAD,
  (II)  A  ONE  THOUSAND  FIVE HUNDRED THIRTY FEET LONG AND SIXTEEN FEET
HIGH PHYSICAL BARRIER BETWEEN THE ROUTE ONE HUNDRED INTERCHANGE AND  THE
PALMER ROAD OVERPASS, AND

 EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                      [ ] is old law to be omitted.

  (III)  A  ONE  THOUSAND  EIGHT HUNDRED FORTY FEET LONG AND TWELVE FEET
HIGH TWO-BARRIER SYSTEM BETWEEN THE  PALMER  ROAD  OVERPASS  AND  DEWITT
AVENUE; AND
  (B)  THE  PHYSICAL  BARRIERS  AUTHORIZED  BY  THIS  SUBDIVISION  TO BE
CONSTRUCTED ON THE NORTHBOUND SIDE OF THE  SPRAIN  BROOK  PARKWAY  SHALL
INCLUDE CONSTRUCTION OF:
  (I)  AN  EIGHT HUNDRED SIXTY FEET LONG AND FOURTEEN FEET HIGH PHYSICAL
BARRIER BETWEEN DEWITT AVENUE AND KIMBALL ROAD,
  (II) A THREE THOUSAND FIVE HUNDRED FORTY FEET LONG  AND  SIXTEEN  FEET
HIGH  PHYSICAL  BARRIER  BETWEEN  PALMER  ROAD AND THE ROUTE ONE HUNDRED
INTERCHANGE,
  (III) A ONE THOUSAND NINE HUNDRED NINETY FEET LONG AND TWENTY-TWO FEET
HIGH PHYSICAL BARRIER BETWEEN THE  ROUTE  ONE  HUNDRED  INTERCHANGE  AND
TUCKAHOE ROAD,
  (IV)  A  SIX  THOUSAND  FOUR HUNDRED SIXTY FEET LONG AND TEN FEET HIGH
PHYSICAL BARRIER BETWEEN TUCKAHOE ROAD AND WINCHESTER DRIVE,
  (V) A TWO THOUSAND ONE HUNDRED NINETY FEET LONG AND FOURTEEN FEET HIGH
PHYSICAL BARRIER BETWEEN WINCHESTER DRIVE AND JENNIFER LANE, AND
  (VI) A ONE THOUSAND THREE HUNDRED EIGHTY FEET LONG  AND  SIXTEEN  FEET
HIGH PHYSICAL BARRIER SOUTH OF JACKSON AVENUE.
  S 2. This act shall take effect immediately.
