  ordered printed, and when printed to be committed to the Committee  on

AN  ACT  to  amend  the  elder  law, in relation to authorizing a pooled
  purchasing program for certain services and commodities

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Section  203  of the elder law is amended by adding a new
subdivision 11 to read as follows:
  11. IN ADDITION TO THE POWERS AND  DUTIES  CONTAINED  IN  SECTION  TWO
HUNDRED TWO OF THIS TITLE, THE OFFICE IS HEREBY AUTHORIZED TO COORDINATE
AND  ENCOURAGE  THE DEVELOPMENT OF, AND/OR COOPERATE WITH NOT-FOR-PROFIT
OR FOR-PROFIT OR PUBLIC ENTITIES, ON BEHALF OF AGING SERVICES  ENTITIES,
DEFINED,  FOR  PURPOSES OF THIS SUBDIVISION AS PROGRAMS AND SERVICES FOR
THE AGING OVER WHICH THE OFFICE HAS JURISDICTION,  OVERSIGHT,  OR  OTHER
CONTRACTUAL  RELATIONSHIP,  FOR  THE OPERATION OF A PURCHASING OR POOLED
PURCHASING PROGRAM FOR CERTAIN SERVICES AND COMMODITIES, INCLUDING,  BUT
NOT  LIMITED  TO, LIABILITY AND MOTOR VEHICLE INSURANCE, AND MOTOR FUEL,
AS SHALL BE DETERMINED BY THE OFFICE AFTER CONSULTATION WITH  THE  ADVI-
SORY COMMITTEE FOR THE AGING AND OTHERS. THE OFFICE SHALL ALSO DEVELOP A
PROCESS  WITH  THE  OFFICE  OF GENERAL SERVICES TO PURCHASE COMMODITIES,
SERVICES,  AND  TECHNOLOGY  THROUGH  THE  OFFICE  OF  GENERAL  SERVICES'
CENTRALIZED  CONTRACTS ON BEHALF OF SUCH AGING SERVICES ENTITIES, PURSU-
ANT TO SECTION ONE HUNDRED SIXTY-THREE OF THE STATE  FINANCE  LAW,  AND,
ANY  OTHER  PROVISION  OF ANY OTHER LAW TO THE CONTRARY NOTWITHSTANDING,
SUCH AGING SERVICES ENTITIES SHALL BE DEEMED NON-STATE  AGENCY  PURCHAS-
ERS,  AS  SUCH  TERM  IS DEFINED IN SUBPARAGRAPH (XII) OF PARAGRAPH K OF
SUBDIVISION ONE OF SECTION ONE HUNDRED SIXTY-THREE OF THE STATE  FINANCE
LAW.
  S 2. This act shall take effect immediately.
