TITLE OF BILL: An act to amend the agriculture and markets law, in
relation to creating a horizontal silo leachate runoff working group

PURPOSE: This bill creates a working group to study the options for
the treatment and management of leachate runoff from horizontal silos.

SUMMARY OF PROVISIONS: The Agriculture and Markets Laws is amended by
adding a new Article 13-F and a new Section 160-w.

Section 1 provides the Commissioner of Agriculture and Markets shall
establish the Horizontal Silo Leachate Runoff Working Group to study
the options for the treatment and management of leachate runoff from
horizontal silos.

Section 2 establishes the membership of the working group which will
include representatives from State and Federal government agencies, as
well as, other organizations and institutions.

Section 3 provides that the working group shall review and study the
options and best practices for the treatment and management of
leachate runoff from horizontal or bunker silos. The working group
shall include in their discussion the cost of such treatment and
management options for the leachate runoff from horizontal or bunker
silos and ways to help farmers reduce the cost associated with this.
Upon the conclusion of their study the working group shall publish a
report outlining their findings.

Section 4 provides that if the need exists, the working group may
continue to exist to address other relevant issues.

This act shall take effect immediately.

JUSTIFICATION: In addition to the traditional vertical farm silos
that rise up above the landscape, there are also horizontal silos,
which spread out across a piece of land. Horizontal silos have many
benefits for farmers. But, one of the drawbacks associated with the
use of horizontal or bunker silos is leachate runoff. Leachate is the
liquid from crops and feed that manifests itself when they are
compacted for storage in horizontal silos. This leachate can seep out
of the silo on its own or it can get mixed in with water that runs off
the silo from precipitation. In either case, the leachate runoff is a
serious concern for farmers because the nutrients in the leachate can
ruin any clean water supply that it comes into contact with.
Therefore, this bill creates a working group that will study the
options and best practices for the treatment and management of
leachate runoff from horizontal or bunker silos. The working group
will include in their study the cost of such options and ways to help
farmers reduce the costs of managing and treating leachate runoff,
which can be very high. Members of various State and Federal
government agencies, as well as the New York State Farm Bureau, the
Northeast Dairy Producers Association and Cornell University will be
part of the working group.

AN ACT to amend the agriculture and markets law, in relation to creating
  a horizontal silo leachate runoff working group

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The agriculture and markets law is amended by adding a  new
article 13-F to read as follows:
                              ARTICLE 13-F
              HORIZONTAL SILO LEACHATE RUNOFF WORKING GROUP
SECTION 160-W. HORIZONTAL SILO LEACHATE RUNOFF WORKING GROUP.
  S 160-W. HORIZONTAL SILO LEACHATE RUNOFF WORKING GROUP. 1. THE COMMIS-
SIONER  SHALL  ESTABLISH  A  WORKING  GROUP TO STUDY THE OPTIONS FOR THE
TREATMENT AND MANAGEMENT OF LEACHATE RUNOFF FROM  HORIZONTAL  OR  BUNKER
SILOS.
  2.  THE  WORKING GROUP SHALL INCLUDE: REPRESENTATIVES FROM THE DEPART-
MENT OF AGRICULTURE AND MARKETS, REPRESENTATIVES FROM THE DEPARTMENT  OF
ENVIRONMENTAL  CONSERVATION,  REPRESENTATIVES FROM EMPIRE STATE DEVELOP-
MENT, REPRESENTATIVES FROM THE NEW YORK  STATE  FARM  BUREAU,  REPRESEN-
TATIVES  FROM  THE  UNITED  STATES  DEPARTMENT  OF  AGRICULTURE  NATURAL
RESOURCE CONSERVATION SERVICE, REPRESENTATIVES FROM THE NORTHEAST  DAIRY
PRODUCERS  ASSOCIATION  AND  REPRESENTATIVES FROM THE APPROPRIATE INSTI-
TUTIONS AT CORNELL UNIVERSITY.
  3. THE WORKING GROUP SHALL MEET REGULARLY AND SHALL REVIEW  AND  STUDY
THE  OPTIONS AND BEST PRACTICES THAT ARE AVAILABLE, INCLUDING THOSE FROM
OTHER STATES, FOR THE TREATMENT AND MANAGEMENT OF LEACHATE  RUNOFF  FROM
HORIZONTAL  OR  BUNKER  SILOS.  THE WORKING GROUP SHALL INCLUDE IN THEIR
DISCUSSION, BUT NOT LIMIT IT TO, THE COST OF SUCH TREATMENT AND  MANAGE-
MENT  OPTIONS  FOR  THE LEACHATE RUNOFF FROM HORIZONTAL OR BUNKER SILOS.

THE GROUP SHALL ALSO INCLUDE IN THEIR DISCUSSION, BUT NOT LIMIT  IT  TO,
WAYS  TO  HELP FARMERS REDUCE THE COST ASSOCIATED WITH THE TREATMENT AND
MANAGEMENT OF LEACHATE RUNOFF FROM HORIZONTAL OR BUNKER SILOS. UPON  THE
CONCLUSION  OF  THEIR  STUDY,  THE WORKING GROUP SHALL PUBLISH A REPORT,
THAT IS WIDELY AVAILABLE, WHICH OUTLINES THE  FINDINGS  OF  THE  WORKING
GROUP. THE REPORT SHALL BE SENT TO THE UNITED STATES DEPARTMENT OF AGRI-
CULTURE NATURAL RESOURCE CONSERVATION SERVICE FOR THEIR REVIEW.
  4.  IF  THE NEED EXISTS, THE WORKING GROUP MAY CONTINUE TO EXIST AFTER
THE PUBLICATION OF THEIR FINDINGS TO ADDRESS OTHER RELEVANT ISSUES WITH-
IN THEIR COMPETENCY.
  S 2. This act shall take effect immediately.
