BILL NUMBER:S5768 TITLE OF BILL: An act to amend the general municipal law, in relation to the town of Islip industrial development agency PURPOSE OR GENERAL IDEA OF BILL: To allow the Town of Islip Office of Economic Development to acquire, construct, renovate, own, maintain, and lease or sell to a private business corporation or private business entity any interest in any project where facilities or property that are primarily used in making retail sales to customers. SUMMARY OF SPECIFIC PROVISIONS: Section 1 states that the opening paragraph of section 898-b of the general municipal law is designated subdivision 1 and a new subdivision 2 is added Section 2 states the effective date. JUSTIFICATION: This bill will allow the Town of Islip Industrial Development Agency to offer its usual tax benefits, including but not limited to, a PILOT Agreement, to a developer who proposes to take title to and remediate a heavily-contaminated former Town landfill and to build a large retail store on the property. Part of the redevelopment plan includes cleaning a heavily polluted freshwater wetland and relocating it (with NYS DEC approval) to a more suitable

BOYLE -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the general municipal law, in relation to the town of Islip industrial development agency THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The opening paragraph of section 898-b of the general municipal law is designated subdivision 1 and a new subdivision 2 is added to read as follows: 2. IN ADDITION TO THE POWERS AND DUTIES NOW OR HEREAFTER CONFERRED BY TITLE ONE OF THIS ARTICLE, THE AGENCY SHALL HAVE THE POWER (I) TO ACQUIRE, CONSTRUCT, RENOVATE, OWN, MAINTAIN, AND LEASE OR SELL TO A PRIVATE BUSINESS CORPORATION OR PRIVATE BUSINESS ENTITY ANY INTEREST IN ANY PROJECT WHERE FACILITIES OR PROPERTY THAT ARE PRIMARILY USED IN MAKING RETAIL SALES TO CUSTOMERS WHO VISIT SUCH FACILITIES CONSTITUTE MORE THAN ONE-THIRD OF THE TOTAL PROJECT COSTS LOCATED IN THE TOWN OF ISLIP, INCLUDING, EASEMENTS AND RIGHT OF WAYS AND ALL NECESSARY AND RELATED EQUIPMENT CONVENIENT FOR THE OPERATION OF SUCH PROJECT, WHERE SUCH PROJECTS ARE TO BE LOCATED ON LAND OWNED OR FORMERLY OWNED BY THE TOWN OF ISLIP AND THE PROJECT APPLICANT OR PROJECT DEVELOPER HAS BEEN SELECTED BY THE TOWN OF ISLIP PURSUANT TO A COMPETITIVELY BID REQUEST FOR PROPOSALS AND SUCH PROJECT APPLICANT OR PROJECT DEVELOPER HAS AGREED ON BEHALF OF THE TOWN OF ISLIP TO COMPLETE AN ENVIRONMENTAL CLEANUP OF THE SITE AND THE TOWN BOARD OF THE TOWN OF ISLIP HAS APPROVED ALL ECONOMIC ASSISTANCE TO BE GRANTED BY THE AGENCY TO THE PROJECT APPLICANT OR PROJECT DEVELOPER AND ANY SUBLEASES OF THE PROJECT, (II) TO FINANCE SUCH FACILITIES THROUGH THE ISSUANCE OF ITS BONDS AND NOTES AND THE GRANTING OF FINANCIAL ASSISTANCE, WHEN IN THE JUDGMENT OF THE AGENCY, SUCH FACILITIES WILL SERVE TO PROMOTE, DEVELOP, ENCOURAGE AND ASSIST IN THE ACQUIRING, CONSTRUCTING, RECONSTRUCTING, IMPROVING, MAINTAINING, EQUIPPING AND FURNISHING OF INDUSTRIAL, MANUFACTURING, WAREHOUSING, EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
