AN ACT to amend the transportation law, in relation to  authorizing  the
  operation  of  pickup  trucks  and vans, having a gross vehicle weight
  rating of eight thousand pounds or less, upon special parkways

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Subdivision 5 of section 71 of the transportation law, as
added by chapter 370 of the laws of 1979, is amended to read as follows:
  5. To limit or prohibit travel by types or classes of commercial vehi-
cles as may be required due to roadway design or safety considerations[,
and to]; PROVIDED, HOWEVER, THAT THE COMMISSIONER  SHALL  NOT  LIMIT  OR
PROHIBIT  THE  TRAVEL  OF  ANY  TYPE OR CLASS OF COMMERCIAL VEHICLE THAT
INCLUDES PICKUP TRUCKS AND VANS HAVING A GROSS VEHICLE WEIGHT RATING  OF
EIGHT  THOUSAND POUNDS OR LESS. IN ADDITION, THE COMMISSIONER MAY estab-
lish speed limits and standards of travel safety  on  all  such  special
parkways designated by this article.
  S 2. This act shall take effect immediately.
