TITLE OF BILL: An act to amend the education law, in relation to
authorizing massage therapists licensed in other jurisdictions to
perform massage demonstrations as part of a continuing education
program

PURPOSE:

To allow massage therapists who are licensed in another state or
country to provide instruction to New York State licensed massage
therapist at programs conducted by a New York State approved provider
of continuing education.

SUMMARY OF PROVISIONS:

Section 1 adds a new paragraph 6 to authorize massage therapists who
are licensed in another state or country to conduct a teaching
clinical demonstration in connection with a program of clinical
education provided by an approved sponsor of continuing education.

Section 2 contains the effective date.

JUSTIFICATION:

In 2012, mandatory continuing education for licensed massage
therapists became effective in New York State. There are presently
17,262 state licensed massage therapists who are required to complete
36 hours of continuing education every three years. As such, there has
been an increase in the number of continuing education courses
conducted by entities approved by the State Education Department in
order to meet the increased need.

The most effective form of instruction for massage therapy is hands on
demonstration. Under current law, a massage therapist must be licensed
in New York State in order to "touch" another persons. There are many
world renowned instructors of massage therapy that are not currently
permitted to provide instruction to massage therapists in New York.

New York State Education Law allows licensed physical therapist and
occupational therapists who are licensed in other states or countries
to conduct a teaching clinical demonstration. This has proven to be
beneficial to both professions and their patients.

Enactment of this legislation would further enhanced the continuing
education component for licensed massage therapist and provide clients
with the best care available.

AN ACT to amend the education law, in relation  to  authorizing  massage
  therapists  licensed  in other jurisdictions to perform massage demon-
  strations as part of a continuing education program

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Section  7805 of the education law is amended by adding a
new subdivision 6 to read as follows:
  6. A MASSAGE THERAPIST LICENSED  IN  ANOTHER  STATE  OR  COUNTRY  FROM
CONDUCTING  A  TEACHING  DEMONSTRATION OF MODALITIES AND TECHNIQUES THAT
ARE WITHIN THE PRACTICE OF MASSAGE THERAPY IN CONNECTION WITH A  PROGRAM
OF  CONTINUING  EDUCATION  THAT  IS  CONDUCTED  BY  APPROVED SPONSORS OF
CONTINUING EDUCATION BY THE DEPARTMENT.
