BILL NUMBER:S6858 TITLE OF BILL: An act to amend the elder law, in relation to making chemical dependence counseling and referrals available in naturally occurring retirement communities PURPOSE OR GENERAL IDEA OF BILL: To increase likelihood that residents of Naturally Occurring Retirement Communities (NORCs) and Neighborhood NORCs who would benefit from chemical dependence counseling and resources receive such assistance. SUMMARY OF SPECIFIC PROVISIONS: Amends paragraph (d) of subdivision 1 of section 209 of the Elder Law to include chemical dependence counseling and referrals as eligible services that NORCs and Neighborhood NORCs may provide to their residents. JUSTIFICATION: As we encourage and support seniors to age in place in their communities, it is important that we help them work through darker times in their lives. There are many paths that can lead an individual to chemical dependence including grief, depression, loneliness, and chronic injury. It is important that we not judge these individuals who have been through so much in their lives. Our seniors should know that if they struggle with chemical dependence, that there are resources available to help them. Making that assistance available within the NORC reduces the stigma and makes it easier for seniors to take advantage of it.

GOLDEN -- read twice and ordered printed, and when printed to be committed to the Committee on Aging AN ACT to amend the elder law, in relation to making chemical dependence counseling and referrals available in naturally occurring retirement communities THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (d) of subdivision 1 of section 209 of the elder law, as amended by chapter 448 of the laws of 2013, is amended to read as follows: (d) "Eligible services" shall mean services including, but not limited to: case management, care coordination, counseling, health assessment and monitoring, transportation, socialization activities, home care facilitation and monitoring, education regarding the signs of elder abuse and exploitation and available resources for a senior who is a suspected victim of elder abuse or exploitation, CHEMICAL DEPENDENCE COUNSELING PROVIDED BY CREDENTIALED ALCOHOLISM AND SUBSTANCE ABUSE COUN- SELORS AS DEFINED IN PARAGRAPH THREE OF SUBDIVISION (D) OF SECTION 19.07 OF THE MENTAL HYGIENE LAW AND REFERRALS TO APPROPRIATE CHEMICAL DEPEND- ENCE COUNSELING PROVIDERS, and other services designed to address the needs of residents of naturally occurring retirement communities by helping them extend their independence, improve their quality of life, and avoid unnecessary hospital and nursing home stays.
