  when printed to be committed to the Committee on Corporations, Author-
  ities and Commissions

AN ACT to amend the  not-for-profit  corporation  law,  in  relation  to
  allowing  cemeteries  in  Nassau county to acquire and utilize certain
  lands for cemetery purposes

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Subparagraph  2  of  paragraph (e) of section 1506 of the
not-for-profit corporation law, as added by chapter 871 of the  laws  of
1977, is amended to read as follows:
  (2)   The provisions of this [subdivision] PARAGRAPH shall not operate
to prevent any such cemetery corporation located in Nassau  county  from
using  for  burial  purposes  contiguous or adjacent land acquired by it
[prior to January first, nineteen hundred forty-eight provided that such
acquisition shall have consisted of less than five acres, and]  provided
[further]  that such use shall be consented to by the [board of supervi-
sors] NASSAU COUNTY LEGISLATURE.
  S 2. This act shall take effect immediately.
