BILL NUMBER:S7915 TITLE OF BILL: An act to amend the public health law, in relation to uncertified dental assistants PURPOSE: Establishes changes to the public health law to require minimum and mandatory educational testing and credentialing standards for an uncertified or unlicensed dental assistant who administers radiologic procedures. SUMMARY OF PROVISIONS: Section 1 of the bill amends paragraph (c) of subdivision 4 of section 3515 of the public health law by removing the ability of certified and uncertified dental assistants, under the supervision of a licensed dentist, to operate only such radiographic dental equipment as may be prescribed by the commissioner in rules and regulations for the sole purpose of dental radiography and requires that only licensed dental assistants, under the supervision of a licensed dentist, may operate only such radiographic dental equipment as may be prescribed by the commissioner in rules and regulations for the sole purpose of dental radiography. Section 2 of the bill establishes the effective date. O'BRIEN -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the public health law, in relation to uncertified dental assistants THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (c) of subdivision 4 of section 3515 of the public health law, as added by chapter 175 of the laws of 2006, is amended to read as follows: (c) a person acting as a [certified] LICENSED dental assistant [or uncertified dental assistant] who, under the supervision of a licensed dentist, operates only such radiographic dental equipment as may be prescribed by the commissioner in rules and regulations for the sole purpose of dental radiography. THE COMMISSIONER IS HEREBY AUTHORIZED AND DIRECTED TO PROMULGATE RULES AND REGULATIONS TO PROHIBIT AN UNLICENSED OR UNCERTIFIED DENTAL ASSISTANT FROM OPERATING RADIOGRAPHIC DENTAL EQUIPMENT PURSUANT TO RULES AND REGULATIONS OF THE COMMISSIONER FOR THE PURPOSE OF DENTAL RADIOGRAPHY; S 2.
