BILL NUMBER:S1963 TITLE OF BILL: An act to amend the education law, in relation to extending certain benefits to those with military service and an honor- able discharge PURPOSE: To allow those with military service and an honorable discharge to attend classes at the State University of New York (SUNY) and the City University of New York (CUNY) on a tuition-free audit basis. SUMMARY OF PROVISIONS: This bill amends Sections 355 and 6206 of the Education Law to include those with military service and an honorable discharge as among those eligible to audit courses at SUNY and CUNY without tuition, examination, grading or credit. JUSTIFICATION: Those with military service and an honorable discharge should be given every opportunity to avail themselves of the wide varie- ty of educational programs offered at the State and City Universities. Attending courses on a tuition-free, space-available basis could be the beginning of a full program of higher education or could be a way of allowing those with military service and an honorable discharge to learn more about a particular area of interest Those with military service and an honorable discharge have contributed greatly to our country and should be encouraged to pursue further education in their chosen fields.

GRIFFO, DeFRANCISCO, GRISANTI, LARKIN, MAZIARZ -- read twice and ordered printed, and when printed to be committed to the Committee on Higher Education AN ACT to amend the education law, in relation to extending certain benefits to those with military service and an honorable discharge THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraph 1 of paragraph h of subdivision 2 of section 355 of the education law, as separately amended by chapters 552 and 616 of the laws of 1985, is amended to read as follows: (1) Notwithstanding the provisions of any other general, special or local law, rule or regulation, such regulations may permit persons sixty years of age or over OR THOSE WITH MILITARY SERVICE AND AN HONORABLE DISCHARGE to audit courses given therein without tuition, examination, grading or credit therefor upon a space available basis, as determined by the president of each such institution, provided that such audit attendance does not deny course attendance at a state-operated institu- tion by an individual who is otherwise qualified under the regulations promulgated pursuant to this section. S 2. Paragraph (b) of subdivision 7 of section 6206 of the education law, as added by chapter 344 of the laws of 1995, is amended to read as follows: (b) Notwithstanding the provisions of any other general, special or local law, rule or regulation, the board of trustees may permit persons sixty years of age or over OR THOSE WITH MILITARY SERVICE AND AN HONOR- ABLE DISCHARGE to audit courses given therein without tuition, examina- tion, grading or credit therefor upon a space available basis, as deter- mined by the president of each such institution, provided that such audit attendance does not deny course attendance at the city university EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. S. 1963 2 of New York by an individual who is otherwise qualified under this section. S 3. This act shall take effect on the first of July next succeeding the date on which it shall have become a law.
