BILL NUMBER:S3496 TITLE OF BILL: An act to amend the criminal procedure law, in relation to designating village of Lake George seasonal constables as peace offi- cers PURPOSE: To provide peace officer status to seasonal employees of the Village of Lake George who are charged with enforcement of local laws. SUMMARY OF PROVISIONS: Section one - provides that employees of the village of Lake George employed as seasonal village constables are hereby designated as peace officers with the power to issue appearance tickets and simplified traf- fic informations for offenses defined in the code of the Village of Lake George and for offenses designated to be violations in the statutes of the state. These officers are further prohibited from carrying firearms unless appropriately licensed pursuant to Section 400.00 of the Penal law. Section two - contains the effective date. EXISTING LAW: Section 2.10 of the Criminal Procedure Law provides for peace officer designation.

Section 2.10 of the criminal procedure law is amended by adding a new subdivision 84 to read as follows: 84. SEASONAL VILLAGE CONSTABLES OF THE VILLAGE OF LAKE GEORGE WHO ARE AUTHORIZED BY THE VILLAGE OF LAKE GEORGE TO ISSUE APPEARANCE TICKETS AND SIMPLIFIED TRAFFIC INFORMATIONS FOR OFFENSES DEFINED IN THE CODE OF THE VILLAGE OF LAKE GEORGE AND FOR OFFENSES DESIGNATED TO BE VIOLATIONS IN THE STATUTES OF THE STATE; PROVIDED, HOWEVER, THAT NOTHING IN THIS SUBDIVISION SHALL BE DEEMED TO AUTHORIZE SUCH OFFICER TO CARRY, POSSESS, REPAIR OR DISPOSE OF A FIREARM UNLESS THE APPROPRIATE LICENSE THEREFOR HAS BEEN ISSUED PURSUANT TO SECTION 400.00 OF THE PENAL LAW. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD08317-01-3
