BILL NUMBER:S3746 TITLE OF BILL: An act to amend the tax law, in relation to peace offi- cers at the video lottery gaming facility at the Aqueduct racetrack PURPOSE: To require the presence of peace officers at the Aqueduct race- track. SUMMARY OF PROVISIONS: Section 1. Amends section 1617-a of the tax law by adding a new subdivi- sion g to require the presence of peace officers at the Aqueduct race- track, pursuant to the approval of the gaming commission. The legis- lation stipulates that these peace officers are not authorized to carry, possess a firearm in the course of their duties. Section 2. The effective date. JUSTIFICATION: Currently, Aqueduct casino employs security guards to ensure the security of the public who attend the site and the employees who work there. However, they are not authorized to make arrests but only to detain an offender until the NYPD arrives. Other casinos such as Empire City Casino, employs peace officers who can make arrests. With Aqueduct employing peace officer with this authority, it will deter future instances of criminal activity and dissuade others who may choose to perpetrate crimes upon the public visiting the casino.

Section 1617-a of the tax law is amended by adding a new subdivision g to read as follows: G. FOR THE PURPOSE OF PRESERVING ORDER, THE OPERATOR OF THE VIDEO LOTTERY GAMING FACILITY AT THE AQUEDUCT RACETRACK IS HEREBY AUTHORIZED, WITH THE APPROVAL OF THE GAMING COMMISSION TO APPOINT FROM TIME TO TIME SPECIAL POLICE OFFICERS, AND THE SAME TO REMOVE AT PLEASURE, WHO, WHEN APPOINTED, SHALL BE PEACE OFFICERS WITH THE SAME POWERS WITHIN AND ABOUT SUCH FACILITY AS ARE SET FORTH IN SECTION 2.20 OF THE CRIMINAL PROCEDURE LAW; PROVIDED, HOWEVER, THAT NOTHING IN THIS SUBDIVISION SHALL BE DEEMED TO AUTHORIZE SUCH EMPLOYEES TO CARRY, POSSESS, REPAIR, OR DISPOSE OF A FIREARM. THE APPOINTMENT OF POLICE OFFICERS IN PURSUANCE OF THIS SECTION SHALL NOT BE DEEMED TO SUPERSEDE IN ANY WAY AT SUCH VIDEO LOTTERY GAMING FACILITY THE AUTHORITY OF PEACE OFFICERS OR POLICE OFFI- CERS OF THE JURISDICTION WHERE SUCH FACILITY IS LOCATED.
