BILL NUMBER:S5781 TITLE OF BILL: An act to direct the commissioner of education to pay the Uniondale union free school district its full state aid apportionment notwithstanding the failure of the California Avenue school to be in session 180 days during the 2012--2013 school year PURPOSE: Ensures Uniondale Union Free School District does not receive a reduction despite the failure of the elementary school to be in session 180 days. SUMMARY OF PROVISIONS: Section one provides that the Commissioner of Education is authorized to disregard the reduction of state aid required by Education Law 3604 due to the elementary school being in attendance for only 179 days. Section two provides that this act shall take effect immediately. JUSTIFICATION: Education Law ยง 3604 provides that, in apportionment of state funds, no school district shall be entitled to any portion of such school

HANNON -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to direct the commissioner of education to pay the Uniondale union free school district its full state aid apportionment notwith- standing the failure of the California Avenue school to be in session 180 days during the 2012--2013 school year THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding the fact that the pupils attending the California Avenue school of the Uniondale union free school district were only in attendance for one hundred seventy-nine days in the 2012--2013 school year, due to no fault of such school district, the commissioner of education is authorized to disregard the reduction of state aid required pursuant to section 3604 of the education law and shall pay such school district its apportionment as if the California Avenue school had been in session for the required one hundred eighty days.
