BILL NUMBER:S7297 TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to prohibiting the imposition of a toll or fee for passage of a motor vehicle over a highway within a city having a population of one million or more PURPOSE: To prohibit the imposition and collection of tolls for the passage of motor vehicles over highways in a city having a population of one million or more. SUMMARY OF PROVISIONS: Section 1 of the bill amends Section 391 by adding another subdivision, 2, which states that notwithstanding any provision of law to the contrary, no person, corporation, public authority, municipality, the state, nor any agency of the state or of a political subdivision thereof shall be authorized to impose or receive a toll or fee for passage of a motor vehicle over any highway within a city having a population of one million or more. Section 2 of the bill is the effective date. JUSTIFICATION:

LANZA -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to prohibiting the imposition of a toll or fee for passage of a motor vehicle over a highway within a city having a population of one million or more THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 391 of the vehicle and traffic law is amended to read as follows: S 391. Rates of toll on motor vehicles. 1. Where a different rate is not otherwise prescribed or permitted by law, any person or corporation maintaining a plank road, turnpike road or bridge and authorized, or which shall be hereafter authorized, to receive tolls for the passage of motor vehicles over the same, may charge and receive for each and every motor vehicle propelled by any power other than animal power, passing over the same, a toll rate not greater than the maximum rate allowed by law to be charged and received for the passage of a vehicle drawn over such road or bridge by two animals, provided that for such motor vehi- cles designed to carry only two persons the rate of toll charged or received shall not exceed the maximum rate allowed by law to be charged and received for the passage of a vehicle drawn over such road or bridge, without a load, by a single animal. 2. NOTWITHSTANDING ANY PROVISION OF LAW TO THE CONTRARY, NO PERSON, CORPORATION, PUBLIC AUTHORITY, MUNICIPALITY, THE STATE, NOR ANY AGENCY OF THE STATE OR OF A POLITICAL SUBDIVISION THEREOF SHALL BE AUTHORIZED TO IMPOSE OR RECEIVE A TOLL OR FEE FOR PASSAGE OF A MOTOR VEHICLE OVER ANY HIGHWAY WITHIN A CITY HAVING A POPULATION OF ONE MILLION OR MORE.
