BILL NUMBER:S7797 TITLE OF BILL: An act relating to alternative exemptions for veterans PURPOSE: This bill would require the division of veterans affairs, in consultation with the department of taxation and finance, within thirty days of this act and once annually thereafter, to reinforce and/or remind assessors of the fact that the Persian Gulf conflict referenced in section 458-a of the real property tax law includes, but is not limited to, hostilities in Afghanistan and Iraq, also known as Operation Iraqi Freedom, Operation Enduring Freedom and Operation New Dawn. SUMMARY OF PROVISIONS: Section 1: See Purpose. Section 2: Effective Date. JUSTIFICATION: In 2013, New York's Attorney General's staff found some inconsistency in interpretations by assessors of section 458-a of the Real Property Tax Law. Due to inconsistent interpretations some veterans have returned home from service in Iraq and Afghanistan to experience difficulties in obtaining a real property tax exemption they are entitled to. This legislation seeks to ensure that assessors statewide are applying the alternative veterans' exemption properly and uniformly so that these brave men and women receive the tax benefits they deserve.

LARKIN -- read twice and ordered printed, and when printed to be committed to the Committee on Veterans, Homeland Securi- ty and Military Affairs AN ACT relating to alternative exemptions for veterans THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The division of veteran affairs, in consultation with the department of taxation and finance, pursuant to its training responsi- bilities provided for in section 310 of the real property tax law, shall within 30 days of the effective date of this act and at least annually thereafter on a date and in a form to be determined by the department of taxation and finance, reinforce and/or remind assessors of the fact that the Persian Gulf conflict referenced in section 458-a of the real prop- erty tax law includes, but is not limited to, hostilities in Afghanistan and Iraq, also known as Operation Iraqi Freedom, Operation Enduring Freedom and Operation New Dawn.
