BILL NUMBER:S1809 TITLE OF BILL: An act to amend the agriculture and markets law, in relation to encouraging community-based organizations to increase opportunities for seniors to participate in community gardens PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to amend the age from 62 years of age to 60 years of age to ensure consistency with how a "senior" is defined in Elder Law. SUMMARY OF SPECIFIC PROVISIONS: This bill would change the age at which an individual would be defined as a senior under this section, from age 62 to 60 years of age. This change would be consistent with the definition of senior, with regard to community services, found in Elder Law. JUSTIFICATION: The change would provide consistency between Elder Law and Agriculture and Markets Law. PRIOR LEGISLATIVE HISTORY:

VALESKY -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the agriculture and markets law, in relation to encour- aging community-based organizations to increase opportunities for seniors to participate in community gardens THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (a) of subdivision 4 of section 31-j of the agri- culture and markets law, as amended by chapter 525 of the laws of 2014, is amended to read as follows: (a) The goals of the task force may include, but are not limited to, the study, evaluation and development of recommendations: (i) to encour- age the establishment and expansion of community gardens by state agen- cies, municipal governments and private parties, (ii) to encourage coop- eration between the activities and operations of community gardens and provision of donated food to local voluntary food assistance programs for the poor and disadvantaged, (iii) to increase the benefits that community gardens may provide to the local community in which they are located, and (iv) to encourage cooperation with community-based organ- izations to increase the opportunities for seniors, those aged [sixty- two] SIXTY years of age or older, to participate in community gardens.
