                                BILL NUMBER:S2673

TITLE OF BILL:  An act to amend the agriculture and markets law, in
relation to federal food safety compliance assistance

PURPOSE:

This bill establishes a Federal Food Safety Compliance Program in New
York State to assist farmers in complying with changes in federal food
safety regulations.

SUMMARY OF PROVISIONS:

Section 1 amends Section 16 of the Agriculture and Markets Law by
adding a new Subdivision 45. This subdivision authorizes the
Department of Agriculture and Markets to establish a Federal Food
Safety Compliance Assistance Program to support farmers in complying
with federal food safety rules. It will also identify sources of
funding to help farmers pay for capital projects that are required to
comply with federal food safety rules.

Section 2 provides the effective date.

JUSTIFICATION:

In 2010, the federal government enacted the Food Safety Modernization

Act (FSMA). This act was the most significant update of federal food
safety laws since 1938. The FSMA provides the federal Food and Drug
Administration (FDA) with broad powers to regulate the way foods are
grown, harvested, and processed. This has resulted in additional
rulemaking, the proliferation of numerous guidance documents, and an
abundance of new standards.

Many farmers, especially those with small family farms, are concerned
about the costs and complexities associated with complying with the
federal FSMA. It is anticipated that some farms will need to modify
their practices and infrastructure in order to comply with the new
regulations. By establishing a Federal Food Safety Compliance Program,
this legislation offers a coordinated approach to assisting farmers'
compliance with federal food safety rules. The program provides a
variety of technical assistance to farmers, including information and
education programs and referrals to help farmers develop or modify
farming, food processing, and manufacturing practices in compliance
with the current federal law. Additionally, the program will use
existing resources to explain the new requirements and identify
funding sources that can be used to help farmers comply with the FSMA.

Farming is an essential component to our state's culture and economy,
and our farmers deserve the support they need to comply with the
national directive. The Food and Safety Compliance Program will
provide the assistance farmers need to meet the requirement of FSMA.

AN  ACT to amend the agriculture and markets law, in relation to federal
  food safety compliance assistance

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 16 of the agriculture and markets law is amended by
adding a new subdivision 45 to read as follows:
  45.  ESTABLISH  A FEDERAL FOOD SAFETY COMPLIANCE ASSISTANCE PROGRAM TO
SUPPORT FARMERS IN COMPLYING WITH FEDERAL FOOD SAFETY RULES.  UNDER SUCH
PROGRAM THE DEPARTMENT SHALL FORM PARTNERSHIPS WITH THE NEW  YORK  STATE
AGRICULTURAL  EXPERIMENT STATION, SOIL AND WATER CONSERVATION DISTRICTS,
COOPERATIVE EXTENSION, AND OTHER FEDERAL AND STATE RESOURCES TO  PROVIDE
SUCH  SUPPORT  AND  SHALL  ASSIST  SUCH  PARTNERS IN SEEKING FEDERAL AND
PRIVATE SOURCES OF FUNDS FOR SUCH PROGRAM ASSISTANCE. THE PROGRAM  SHALL
PROVIDE  TECHNICAL ASSISTANCE TO FARMERS, INCLUDING, BUT NOT LIMITED TO,
INFORMATION AND EDUCATION PROGRAMS AND REFERRALS TO HELP SUCH FARMERS IN
DEVELOPING OR MODIFYING FARMING, FOOD PROCESSING AND MANUFACTURING PRAC-
TICES TO ACHIEVE COMPLIANCE WITH CURRENT FEDERAL  FOOD  SAFETY  REQUIRE-
MENTS.  THE  DEPARTMENT  SHALL  CONSULT  WITH THE DEPARTMENT OF ECONOMIC
DEVELOPMENT TO IDENTIFY SOURCES OF FUNDING TO ASSIST  FARMERS  THAT  MAY
NEED TO INITIATE CAPITAL PROJECTS TO COMPLY WITH CHANGES IN FEDERAL FOOD
SAFETY RULES.
