BILL NUMBER:S3345 TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to including the examination of tinted or shaded windows in the periodic inspection of motor vehicles PURPOSE: To include the examination of tinted or shaded windows in the periodic inspection of motor vehicles. SUMMARY OF SPECIFIC PROVISIONS: Section 1 - Amends subparagraph (a) of paragraph 1 of subdivision (c) of section 301 of the vehicle and traffic law, as amended by section 5 of part VI of Chapter 62 of the laws of 2003. Section 2 - Effective date JUSTIFICATION: Many vehicle owners are currently violating the law by having tinted glass that exceeds current regulations regarding the degree of tint. DeFRANCISCO -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to including the examination of tinted or shaded windows in the periodic inspection of motor vehicles THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraph (a) of paragraph 1 of subdivision (c) of section 301 of the vehicle and traffic law, as amended by section 5 of part V1 of chapter 62 of the laws of 2003, is amended to read as follows: (a) A safety inspection shall be made with respect to the brakes; steering mechanism; wheel alignment; lights, including but not limited to the lights which are designed and placed on a vehicle for the purpose of illuminating the vehicle's license plates; odometer; tire pressure; seat safety belts; shoulder harness safety belts; ANY WINDOW WHICH IS COMPOSED OF, COVERED BY OR TREATED WITH ANY MATERIAL WHICH HAS A LIGHT TRANSMITTANCE OF LESS THAN SEVENTY PERCENT PURSUANT TO SECTION THREE HUNDRED SEVENTY-FIVE OF THIS TITLE and such other mechanisms and equip- ment as shall be determined by the commissioner to be necessary for proper and safe operations. Such inspection shall also be made with respect to vehicle identification number. Upon inspection, the mileage appearing on the odometer shall be recorded upon the inspection sticker. S 2. This act shall take effect on the first of January next succeed- ing the date on which it shall have become a law; provided that the commissioner of motor vehicles is authorized to promulgate any and all rules and regulations necessary and take any other measures necessary to implement this act on its effective date on or before such date. BILL NUMBER: S3345A TITLE OF BILL : An act to amend the vehicle and traffic law, in relation to tinted or shaded windows of motor vehicles PURPOSE : To prohibit the tinting or shading of rear windows on motor vehicles registered in New York State SUMMARY OF SPECIFIC PROVISIONS : Section 1 Amends subparagraph (a) of paragraph 1 of subdivision (c) of section 301 of the vehicle and traffic law, as amended by section 5 of part VI of Chapter 62 of the laws of 2003. Section 2 - Effective date JUSTIFICATION : Currently tinted windows on the front windshield and front sides which exceed 70% of light transmittance are prohibited on motor vehicles registered in NYS. By permitting tinted glass on the back windows of a vehicle, it encourages individuals to violate existing law preventing tint on front windows. Glass that is too dark inhibits other drivers from making necessary eye contact with a driver to understand their

Subparagraph 4 of paragraph (b) of subdivision 12-a of section 375 of the vehicle and traffic law, as amended by chapter 155 of the laws of 1991, is amended to read as follows: (4) the rear window of which is composed of, covered by or treated with any material which has a light transmittance of less than seventy percent. [A rear window may have a light transmittance of less than seventy percent if the vehicle is equipped with side mirrors on both sides of the vehicle so adjusted that the driver thereof shall have a clear and full view of the road and condition of traffic behind such vehicle.] S 2. This act shall take effect on the first of January next succeed- ing the date on which it shall have become a law; provided that the commissioner of motor vehicles is authorized to promulgate any and all rules and regulations necessary and take any other measures necessary to implement this act on its effective date on or before such date.
